【摘要】：遠(yuǎn)東國(guó)際軍事法庭的管轄權(quán)直接關(guān)涉東京審判的合法性。法庭上的辯護(hù)方和日后的東京審判的否定派,主要從"勝者的法庭"和"事后法"兩個(gè)方向質(zhì)疑法庭管轄權(quán)的法律依據(jù)和法理基礎(chǔ)�；�于法庭文獻(xiàn)和國(guó)際法原理的分析可以發(fā)現(xiàn),東京審判管轄權(quán)在法律上有著明確的依據(jù)和堅(jiān)實(shí)的基礎(chǔ),東京審判管轄權(quán)的確立反映了戰(zhàn)爭(zhēng)法觀的演變、人道人權(quán)觀念的進(jìn)步以及國(guó)際法的漸進(jìn)發(fā)展,實(shí)現(xiàn)了對(duì)戰(zhàn)爭(zhēng)與和平的"法的支配"。東京審判的合法性不容置疑,管轄權(quán)之爭(zhēng)應(yīng)當(dāng)走向終結(jié)。
[Abstract]:The jurisdiction of the far East International military Court is directly related to the legality of the Tokyo trial. The defense in the court and the negatives of the Tokyo trial in the future mainly challenge the legal basis and the legal basis of the jurisdiction of the court from the two directions of "the court of the victor" and "the law of hindsight". Based on the analysis of the literature of the court and the principles of international law, it can be found that the Tokyo trial jurisdiction has a clear legal basis and a solid foundation, and the establishment of the Tokyo trial jurisdiction reflects the evolution of the concept of the law of war. The progress of the concept of human rights and the progressive development of international law have realized the rule of law over war and peace. The legitimacy of the Tokyo trial is beyond doubt, and the dispute over jurisdiction should come to an end.
