【摘要】：從原始民主治理與人權(quán)保障血緣化、奴隸主"神權(quán)"統(tǒng)治與人權(quán)保障身份化、封建社會(huì)的治理與人權(quán)保護(hù),到資本主義"物的依賴"治理模式與人權(quán)保障的契約化,治理的演進(jìn)從未脫離關(guān)于人的思考,但物質(zhì)制約性決定其治理模式與人權(quán)保障存在局限性,并未實(shí)現(xiàn)國(guó)家戰(zhàn)略與人民根本利益的統(tǒng)一,而發(fā)達(dá)國(guó)家主導(dǎo)的全球治理與人權(quán)保障領(lǐng)域同樣出現(xiàn)了悖論。中國(guó)國(guó)家治理體系與治理能力現(xiàn)代化致力于實(shí)現(xiàn)"治理權(quán)"與發(fā)展權(quán)、治理現(xiàn)代化與人的現(xiàn)代化的有機(jī)統(tǒng)一以及法制體系向法治體系的轉(zhuǎn)變,開創(chuàng)人權(quán)保障的中國(guó)道路。
[Abstract]:From the origin of primitive democratic governance and human rights protection, the domination of the slave owners and the protection of human rights, the governance and protection of the feudal society and the protection of human rights, the contract of the governance mode of "dependence on things" and the protection of human rights, the evolution of governance never divorced from the thinking of human beings, but the material constraints determine its governance model and human rights protection. The limitation of the barrier has not realized the unity of the national strategy and the fundamental interests of the people, while the global governance led by the developed countries and the field of human rights guarantee also appear paradoxes. The modernization of China's national governance system and governance capacity is devoted to the realization of the right to governance and the right to development, the organic unification of the modernization of the governance and the modernization of human beings and the law. The transformation of the system to the rule of law will create a China road for human rights protection.
