【摘要】：證據(jù)問題是爭(zhēng)議解決程序規(guī)則的核心問題。在經(jīng)濟(jì)全球化趨勢(shì)下,跨國(guó)商事爭(zhēng)議也隨之增多,而在眾多爭(zhēng)議解決的途徑中,仲裁的便捷、保密和可執(zhí)行性使其廣受認(rèn)可。規(guī)范商事仲裁中的證據(jù)實(shí)踐,對(duì)約束仲裁庭與當(dāng)事人存在積極作用,利于我國(guó)仲裁活動(dòng)的發(fā)展并降低當(dāng)事人在我國(guó)解決爭(zhēng)議的成本并提高其可靠性。然而目前我國(guó)各大商事機(jī)構(gòu)均無詳細(xì)的成文規(guī)則,也沒有關(guān)于證據(jù)問題的指導(dǎo)意見。本文結(jié)合我國(guó)現(xiàn)行法律制度,圍繞商事仲裁中的幾個(gè)證據(jù)問題加以討論,包括當(dāng)事人約定證據(jù)規(guī)則的法律效果、出示請(qǐng)求制度、舉證責(zé)任分配、證據(jù)特免權(quán)等問題等,研究我國(guó)商事仲裁活動(dòng)中上述證據(jù)規(guī)則的構(gòu)建和改進(jìn)的可選方案并提出相關(guān)建議,為仲裁證據(jù)問題的研究提出微薄意見。
[Abstract]:The problem of evidence is the core of the rules of dispute settlement procedure. Under the trend of economic globalization, transnational commercial disputes also increase, and among the many dispute settlement approaches, arbitration is widely recognized by its convenience, confidentiality and enforceability. Standardizing the practice of evidence in commercial arbitration has a positive effect on binding the arbitration tribunal and the parties, which is conducive to the development of arbitration activities in China and to reduce the cost of dispute resolution and improve the reliability of the parties in China. However, there are no detailed written rules or guidance on evidence in China. This paper discusses several evidence problems in commercial arbitration, including the legal effect of the rules of evidence agreed by the parties, the system of presentation request, the distribution of the burden of proof, the power of special exemption of evidence, and so on. This paper studies the construction and improvement of the evidence rules in China's commercial arbitration activities and puts forward some suggestions for the study of the arbitration evidence.
