【摘要】：二十一世紀(jì)的到來，全球的貿(mào)易環(huán)境發(fā)生了巨大的變化。首先，全球貿(mào)易環(huán)境的變化。經(jīng)濟一體化已經(jīng)成為全球經(jīng)濟的發(fā)展趨勢，越來越多的國家和地區(qū)形成區(qū)域組織，例如歐盟，因此越來越多的國家之間取消了關(guān)稅制度；其次，國際安全環(huán)境的變化。2001年“9.11”恐怖襲擊事件的發(fā)生，各國都不斷加強安全保護(hù)力度。在貿(mào)易領(lǐng)域，各國出于從源頭上控制恐怖因素的初衷，紛紛加強海關(guān)進(jìn)出口貨物的檢查工作。第三，全球科學(xué)技術(shù)的發(fā)展。科技的發(fā)展促進(jìn)電子票據(jù)在國際貿(mào)易中的廣泛運用，另外，貨物的運輸中也出現(xiàn)了各種新形式，比如集裝箱運輸。國際環(huán)境在各領(lǐng)域的變化促使國際商會對《國際貿(mào)易術(shù)語解釋通則》再次修訂，并且新版通則于2011年起生效�！秶�際貿(mào)易術(shù)語解釋通則》歷來對各國之間的貿(mào)易都有著舉足輕重的影響，因此新版通則的變化也是各界所關(guān)注的。目前，此方面的研究成果還較少，筆者在本文中試作分析。 第一章是對《國際貿(mào)易術(shù)語解釋通則》的概述。首先介紹了《貿(mào)易術(shù)語解釋通則》的產(chǎn)生過程以及歷次的修訂；在第二節(jié)中，筆者分析了此次修訂的原因：一方面是由于《通則2000》自身還存留一些缺陷，另一方面則是由于國際形勢的變化促使國際商會對《通則2000》作出修改。 第二章對《國際貿(mào)易術(shù)語解釋通則2010》的具體修訂內(nèi)容作出闡述，分別從三個角度闡述變化：框架結(jié)構(gòu)的變化、貿(mào)易術(shù)語的構(gòu)成變化以及貿(mào)易術(shù)語具體內(nèi)容的變化。 針對與貨物銷售相關(guān)的其它法律，如《聯(lián)合國國際銷售合同公約》以及我國的《合同法》，筆者也將這兩部法律與《國際貿(mào)易術(shù)語解釋通則2010》進(jìn)行分析對比。第三章是將《聯(lián)合國國際銷售合同公約》與新版通則進(jìn)行對比分析，主要是通過對兩者的一致性與差異性著手研究；第四章則是分析比較《合同法》與新版通則的區(qū)別，主要是從以下兩個方面：一是貨物所有權(quán)問題；二是貨物風(fēng)險轉(zhuǎn)移問題。 最后一章分析了《國際貿(mào)易術(shù)語解釋通則2010》對我國貿(mào)易的影響。新版通則的出現(xiàn)并不意味著之前版本的無效，為避免糾紛，，使用者應(yīng)該明確約定采用哪個版本。面對貿(mào)易術(shù)語內(nèi)容的變化，貿(mào)易雙方應(yīng)根據(jù)實際情況采用最有利的術(shù)語。另外，碼頭作業(yè)費用的分配也會對雙方的成本產(chǎn)生影響。最后分析了各國信息安全要求對我國貿(mào)易的影響。
[Abstract]:With the arrival of the 21 century, the global trading environment has undergone tremendous changes. First, changes in the global trading environment. Economic integration has become a trend in the global economy, with more and more countries and regions forming regional organizations, such as the European Union, as a result of which tariff regimes have been abolished among more and more countries. The change of international security environment. With the terrorist attacks of September 11, 2001, all countries have strengthened their security protection. In the field of trade, countries strengthen customs inspection of import and export goods in order to control terrorist factors from the source. Third, the development of global science and technology. The development of science and technology promotes the wide use of electronic instruments in international trade. In addition, various new forms of transport of goods, such as container transport, have emerged. The changes in the international environment in various fields have prompted the International Chamber of Commerce to revise again the Incoterms, The Incoterms have always had an important influence on the trade between countries, so the change of the new general rules is also concerned by all circles. At present, there are few research results in this field, the author in this paper pilot analysis. Chapter one is an overview of Incoterms. First of all, the author introduces the production process of "General principles of interpretation of Trade terms" and the successive revisions. In the second section, the author analyzes the reasons for this revision: on the one hand, there are still some defects in "General principles 2000". On the other hand, because of the changes in the international situation, ICC revised the General principles 2000. The second chapter expounds the revision of Incoterms 2010 from three angles: the change of frame structure, the change of composition of trade terms and the change of specific content of trade term. In view of other laws related to the sale of goods, such as the United Nations Convention on contracts for International Sale and the contract Law of China, the author also makes an analysis and comparison between these two laws and Incoterms 2010. The third chapter is a comparative analysis of the United Nations Convention on International sales contracts and the new general principles, mainly through the consistency and difference between the two, the fourth chapter is to compare the differences between the contract Law and the new general principles. Mainly from the following two aspects: one is the ownership of goods, the other is the transfer of goods risk. The last chapter analyzes the influence of Incoterms 2010 on China's trade. The emergence of the new general rules does not mean that the previous version is invalid, in order to avoid disputes, users should specify which version to adopt. In the face of changes in the content of trade terms, both parties should adopt the most favorable terms according to the actual situation. In addition, the allocation of terminal operating costs will also have an impact on the cost of both sides. Finally, the influence of information security requirements on China's trade is analyzed.
