【摘要】：運(yùn)用文獻(xiàn)資料法等,從法律權(quán)能的角度研究國(guó)際體育組織在國(guó)際體育法中的角色,分析其法律意義上的功能、作用以及影響。主要結(jié)論:國(guó)際體育組織的法律權(quán)能結(jié)構(gòu)包括"立法"("造法")權(quán)能、"執(zhí)法"權(quán)能和"司法"權(quán)能,是比較完整的法律權(quán)能結(jié)構(gòu);國(guó)際體育組織的這三項(xiàng)法律權(quán)能決定了國(guó)際體育法的制定、執(zhí)行和適用,形成了獨(dú)具特色的國(guó)際體育內(nèi)部自治法律秩序;國(guó)際體育組織的法律權(quán)能一方面對(duì)傳統(tǒng)的國(guó)際法理論帶來(lái)了一定的沖擊和挑戰(zhàn),另一方面也充實(shí)了現(xiàn)有的國(guó)際法理論體系,促進(jìn)了現(xiàn)代國(guó)際法的發(fā)展;國(guó)際體育組織的發(fā)展應(yīng)倚重現(xiàn)代國(guó)際法的發(fā)展,受到必要的國(guó)際法律規(guī)制。
[Abstract]:In this paper, the role of international sports organizations in international sports law is studied from the angle of legal power, and its function, function and influence in the legal sense are analyzed by using the method of literature and materials. The main conclusions are as follows: the legal power structure of international sports organizations includes "legislation" ("law-making") power, "law enforcement" power and "justice" power, which is a relatively complete legal power structure; These three legal powers of international sports organizations determine the formulation, implementation and application of international sports law, and form a unique legal order of internal autonomy of international sports; On the one hand, the legal power of international sports organizations brings a certain impact and challenge to the traditional theory of international law, on the other hand, it also enriches the existing theoretical system of international law and promotes the development of modern international law. The development of international sports organization should rely on the development of modern international law and be regulated by necessary international law.
