【摘要】：勞工問(wèn)題是當(dāng)今世界面臨的牽涉面最廣的重大問(wèn)題之一。在貿(mào)易自由化的背景下,勞工標(biāo)準(zhǔn)與貿(mào)易交織在一起,正日益受到多種角度的關(guān)注。WTO作為協(xié)調(diào)不同國(guó)家之間貿(mào)易規(guī)則的全球性組織,勞工標(biāo)準(zhǔn)問(wèn)題被認(rèn)為是對(duì)其在未來(lái)發(fā)展的挑戰(zhàn)之一。盡管各成員立場(chǎng)各不相同,但勞工標(biāo)準(zhǔn)納入WTO也有其合理性,已是大勢(shì)所趨。本文在介紹勞工標(biāo)準(zhǔn)的基礎(chǔ)上,圍繞勞工標(biāo)準(zhǔn)與國(guó)際貿(mào)易的關(guān)系、勞工標(biāo)準(zhǔn)與WTO的關(guān)系、中國(guó)勞動(dòng)法制的完善三個(gè)問(wèn)題展開論述,并提出相關(guān)的看法與建議。 本文分為四章,第一章給出勞工標(biāo)準(zhǔn)的定義,從其淵源以及意義分析說(shuō)明勞工標(biāo)準(zhǔn);第二章分析勞工標(biāo)準(zhǔn)與國(guó)際貿(mào)易之間的沖突與協(xié)調(diào)關(guān)系,各國(guó)利益的差異與博弈;第三章回顧WTO勞工標(biāo)準(zhǔn)問(wèn)題的歷史進(jìn)程,從WTO的權(quán)限、WTO體系外貿(mào)易與勞工的聯(lián)系以及WTO規(guī)則的制定三方面分析,指出勞工標(biāo)準(zhǔn)納入WTO是大勢(shì)所趨;從經(jīng)濟(jì)全球化、國(guó)際勞工組織的不足以及發(fā)達(dá)國(guó)家和發(fā)展中國(guó)家在勞工問(wèn)題上存在著共同利益三方面分析,指出勞工標(biāo)準(zhǔn)納入WTO有其合理性;最后還對(duì)勞工標(biāo)準(zhǔn)納入WTO提出幾點(diǎn)看法;第四章在前三章的基礎(chǔ)上,指出我國(guó)勞動(dòng)法應(yīng)適應(yīng)勞工標(biāo)準(zhǔn)的要求,有所回應(yīng),應(yīng)對(duì)勞動(dòng)法制進(jìn)行完善,加強(qiáng)我國(guó)勞動(dòng)法對(duì)勞動(dòng)者的保護(hù),包括完善勞動(dòng)立法,加強(qiáng)執(zhí)法力度,改進(jìn)對(duì)勞動(dòng)者權(quán)益的法律救濟(jì)措施等。
[Abstract]:In the context of trade liberalization, labor standards are intertwined with trade. WTO is being paid more and more attention from many angles. WTO is a global organization to coordinate the trade rules between different countries. The issue of labor standards is considered to be one of the challenges to its future development. Although the positions of different members are different, it is reasonable for labour standards to be incorporated into WTO. Based on the introduction of labor standards, this paper discusses the relationship between labor standards and international trade, the relationship between labor standards and WTO, and the perfection of China's labor legal system. And put forward the relevant views and suggestions. This paper is divided into four chapters. The first chapter gives the definition of labor standard and explains the labor standard from its origin and meaning. The second chapter analyzes the conflict and coordination between labor standards and international trade, the differences of national interests and the game. The third chapter reviews the historical process of WTO labor standards, and analyzes the relationship between trade and labor outside the WTO system and the establishment of WTO rules. It is pointed out that the integration of labor standards into WTO is the trend of the times. From the aspects of economic globalization, the shortcomings of ILO and the common interests of developed and developing countries in labor issues, the author points out that it is reasonable for labor standards to be incorporated into WTO. Finally, this paper puts forward some views on the integration of labor standards into WTO. On the basis of the first three chapters, Chapter 4th points out that China's labor law should meet the requirements of labor standards, respond to it, improve the labor legal system, and strengthen the protection of labor law, including the improvement of labor legislation. Strengthen law enforcement and improve legal remedies for workers' rights and interests.
