【摘要】：“健全行政執(zhí)法和刑事司法銜接機(jī)制，，完善案件移送標(biāo)準(zhǔn)和程序，建立行政執(zhí)法機(jī)關(guān)、公安機(jī)關(guān)、檢察機(jī)關(guān)、審判機(jī)關(guān)信息共享、案情通報、案件移送制度，堅決克服有案不移、有案難移、以罰代刑現(xiàn)象，實現(xiàn)行政處罰和刑事處罰的無縫對接�！鄙鲜鰞�(nèi)容是十八界四中全會公報中的一部分，該部分內(nèi)容反映出了當(dāng)前司法形勢下執(zhí)法機(jī)關(guān)、公安機(jī)關(guān)、檢察機(jī)關(guān)、審判機(jī)關(guān)存在著嚴(yán)重問題。有鑒于此，本文通過從民刑交叉案件的形成原因入手進(jìn)行分析，剖析了法院在立、審、執(zhí)過程中對民刑交叉案件處理存在的困難，也列舉了目前實踐中法院審理民刑交叉案件的真實案例分析，并且從刑訴法、民訴法等視角，提出了處理民刑交叉案件的建議。
[Abstract]:"to improve the convergence mechanism between administrative law enforcement and criminal justice, to perfect the standards and procedures for the transfer of cases, and to establish a system of information sharing between administrative law enforcement organs, public security organs, procuratorial organs, judicial organs, notification of cases and transfer of cases," "We must resolutely overcome the problem of not moving cases and difficult to remove cases, so as to achieve a seamless docking between administrative punishment and criminal punishment." The above contents are part of the communique of the fourth Plenary session of the 18th CPC Central Committee, which reflects the serious problems existing in the law enforcement organs, public security organs, procuratorial organs and judicial organs under the current judicial situation. In view of this, this paper analyzes the reasons for the formation of civil and criminal cross cases, and analyzes the difficulties existing in the handling of civil and criminal cross cases in the process of court establishment, trial and execution. It also enumerates the real case analysis of the trial of civil and criminal cross cases in court at present, and puts forward some suggestions to deal with civil and criminal cross cases from the angles of criminal procedure law, civil procedure law and so on.
