【摘要】：新刑事訴訟法在2013年1月開始正式施行，“尊重和保障人權(quán)”作為最突出的亮點被寫入這部法律的總則。刑事訴訟法是國家權(quán)力和公民權(quán)利最容易發(fā)生激烈沖突的領域，公權(quán)力的行使直接影響公民的基本權(quán)利。在這部國家基本法中寫入尊重人權(quán)原則，不僅具有宣示的意義，更昭示著刑事立法和司法正朝著更加人性的方向發(fā)展。與此同時，新刑訴法將律師介入訴訟的時間點提前，規(guī)定了非法證據(jù)排除、不得自證其罪規(guī)則，拘留逮捕后立即送所，訊問時錄音錄像、擴大法律援助對象、細化逮捕條件等保護被追訴人權(quán)利的制度。然而，，在欣喜人權(quán)保護的地位被提到顯眼高度的同時，筆者也遺憾的看到，在具體規(guī)定和制度中，新刑訴法仍缺乏對女性這類弱勢群體的特殊保護。作為犯罪嫌疑人、被告人，由于女性特殊的生理、心理狀況，如若對她們采用的強制措施與男性一視同仁，則很有可能侵犯其生育、墮胎、產(chǎn)假等等基本人權(quán)，這與刑訴法的主旨絕對是背道而馳的。減少在刑事司法領域現(xiàn)實存在的男女不平等問題，是保障人權(quán)應有的題中之義。結(jié)合檢察工作經(jīng)驗，筆者試以女性犯罪嫌疑人、被告人作為研究對象，探究現(xiàn)行刑事訴訟在保護女性權(quán)益制度上的缺漏，提出完善制度的構(gòu)想。全文共分四個部分。第一部分闡述保護女性被追訴人的必要性。第二部分分析了女性被追訴人保護機制的缺失及成因，第三部分強調(diào)保護女性被追訴人時應遵循的原則，第四部分針對偵查、起訴、審判、執(zhí)行各階段提出對女性被追訴人特殊保護的完善措施。
[Abstract]:The new Code of Criminal procedure came into effect in January 2013, and "respect and protect human rights" as the most prominent highlight of the law is included in the general principles of the law. The criminal procedure law is the area where the state power and the citizen's rights are most likely to conflict, and the exercise of the public power directly affects the citizen's basic rights. The incorporation of the principle of respect for human rights in the basic Law of this country is not only of declared significance, but also of the fact that the criminal legislation and the judiciary are developing towards a more humane direction. At the same time, the new Criminal procedure Law advances the time point for lawyers to intervene in the proceedings, prescribes the exclusion of illegal evidence, does not allow for self-incrimination, immediately after detention and arrest, sends audio and video recordings during interrogation, and expands the target of legal aid. However, while the status of human rights protection has been raised to a prominent height, I regret to see that in the specific provisions and system, the new criminal procedure law still lacks special protection for vulnerable groups such as women. As suspects and defendants, because of the special physical and psychological conditions of women, if they are treated equally with men, they are likely to violate their basic human rights, such as childbirth, abortion, maternity leave, etc. This is absolutely contrary to the thrust of the Criminal procedure Law. Reducing the inequality between men and women in the criminal justice field is an important part of the protection of human rights. Combined with the experience of procuratorial work, the author tries to take female criminal suspects and defendants as the object of study, to explore the shortcomings of the current criminal procedure in protecting the rights and interests of women, and to put forward the idea of perfecting the system. The full text is divided into four parts. The first part expounds the necessity of protecting the female prosecution. The second part analyzes the absence and causes of female prosecution protection mechanism, the third part emphasizes the principles to be followed in the protection of female prosecution, the fourth part focuses on investigation, prosecution and trial. In each stage of implementation, the author puts forward the perfect measures for the special protection of the female prosecution.
