【摘要】：隨著城市化進程的日益推進，城中村作為一種特殊的村落出現(xiàn)在我國迅速發(fā)展的城市中，阻礙了城鄉(xiāng)一體化的發(fā)展。改造城中村勢在必行，然而城中村是我國城鄉(xiāng)二元制度結(jié)構(gòu)與相關(guān)制度缺陷的一個縮影，，改造城中村困難重重。作為我國城市化發(fā)展中的特有現(xiàn)象，城中村的形成原因和現(xiàn)存問題都是多方面的，其中，土地使用權(quán)問題是城中村研究的核心問題。城中村現(xiàn)象的形成、顯現(xiàn)、發(fā)展和改造是與城中村土地使用制度的變遷密切相關(guān)的。 近年來，學者們對城中村的研究主要集中在經(jīng)濟學和社會學的內(nèi)容方面，在一定程度上忽略了法律方面的探討。本文從法律層面上研究城中村改造問題，分析城中村土地使用的現(xiàn)狀特征及存在的問題，在找出形成城中村土地不合理使用的制度因素的基礎上提出城中村土地使用權(quán)制度創(chuàng)新的模式，從而在制度創(chuàng)新層面上揭示了城中村改造的新機制。
[Abstract]:As the urbanization process advances , the village as a special village appears in the rapidly developing city of China , which has hindered the development of urban and rural integration . However , the village is one of the main problems in the development of urbanization in China . However , the problem of land use right is the core problem in the study of urban and rural villages . The formation , appearance , development and transformation of village phenomenon in the city are closely related to the change of the land use system in the village . In recent years , scholars have mainly focused on the contents of economics and sociology , and neglect the legal aspects to a certain extent . In this paper , the author studies the problems of village reconstruction in the city , analyzes the present situation and existing problems of the land use in the village , and puts forward the mode of the system innovation of the land use right system in the village and the village , and reveals the new mechanism of the transformation of the village and the village in the system innovation level .
