【摘要】：城管執(zhí)法制度已經運行了多年，在此期間，確實為我國的城市管理做出了突出的貢獻，市容市貌有了極大的改善。然而在取得成績的同時，也存在著一定的問題。隨著國家城市化進程的加快，綜合行政執(zhí)法體制所擔負的社會使命愈來愈重，法律規(guī)范的不健全、權力與職責的不統(tǒng)一，使綜合行政執(zhí)法部門一直成為社會負面輿論的焦點。城管執(zhí)法制度至今還沒有走向成熟，在執(zhí)法的過程中屢屢發(fā)生暴力執(zhí)法事件、暴力抗法事件，進而引發(fā)大規(guī)模的暴力沖突事件。正是因為這些事件的屢屢出現(xiàn)，，充斥在民眾的視線之中，使民眾對城管執(zhí)法制度是否合法、是否正當產生了質疑，要求廢除城管執(zhí)法制度的呼聲也是不絕于耳。 城管執(zhí)法制度的法律正當性遭受了嚴重的危機，其發(fā)展也出現(xiàn)了瓶頸。本文試圖從正當性出發(fā)對城市綜合執(zhí)法制度進行研究，以此為基礎發(fā)現(xiàn)城市綜合執(zhí)法制度中的問題及其原因，并找出解決問題的方法，全文分為三個部分：一是對綜合執(zhí)法制度和法律正當性的含義作出分析，厘清制度的產生和發(fā)展脈絡，整理出制度的法律規(guī)定。二是找出制度法律正當性的問題并分析原因。三是針對問題提出解決的措施。
[Abstract]:The urban management law enforcement system has been in operation for many years. During this period, it has indeed made outstanding contributions to the urban management of our country, and the appearance of the city has been greatly improved. However, at the same time, With the acceleration of the process of urbanization in the country, the social mission of the comprehensive administrative law enforcement system is becoming more and more important, the legal norms are not perfect, and the power and duty are not unified. The comprehensive administrative law enforcement departments have been the focus of negative public opinion. The law enforcement system of urban management has not yet matured. In the process of law enforcement, violent law enforcement incidents and violent anti-law incidents occur frequently. It is precisely because of the frequent occurrence of these incidents, which are flooded in the eyes of the public, that the people question whether the law enforcement system of urban management is legitimate or not. Calls for the abolition of the chengguan law enforcement system are also heard. The legal legitimacy of urban management law enforcement system has suffered a serious crisis, and its development has also appeared bottleneck. This paper attempts to study the urban comprehensive law enforcement system from the perspective of legitimacy. On this basis, we find out the problems and their causes in the urban comprehensive law enforcement system, and find out the methods to solve the problems. The full text is divided into three parts: one is to analyze the meaning of the comprehensive law enforcement system and the legitimacy of the law. To clarify the emergence and development of the system, to sort out the legal provisions of the system, the second is to find out the legal legitimacy of the system and analyze the reasons, and the third is to put forward measures to solve the problem.
