【摘要】：從信訪制度演進(jìn)發(fā)展與權(quán)利屬性看,信訪行為自始就具有民主監(jiān)督與權(quán)利救濟(jì)之雙重功能。信訪制度改革不能忽略信訪制度的元問(wèn)題即信訪行為中所蘊(yùn)藏的權(quán)利及其功能。從信訪行為的權(quán)利屬性分析,建議與批評(píng)權(quán)屬于民主監(jiān)督的范疇;而控告除具有民主監(jiān)督的功能外,更兼具權(quán)利救濟(jì)之功能;取得賠償權(quán)本身是權(quán)利救濟(jì)的核心內(nèi)容。信訪行為的雙重功能在1978年改革開(kāi)放前后是有較大差異的,隨著中國(guó)特色社會(huì)主義法律體系的形成與完善,民主監(jiān)督的功能需要進(jìn)一步強(qiáng)化,而權(quán)利救濟(jì)的功能則需要逐步式微與消失,進(jìn)而實(shí)現(xiàn)監(jiān)督與救濟(jì)功能之最終分離,讓信訪制度回歸其民主監(jiān)督的軌道上。這可能才是信訪制度改革之方向。
[Abstract]:From the perspective of the evolution and development of the petition system and the property of the right, From the beginning, the petition behavior has the dual function of democratic supervision and right relief. The reform of the petition system cannot ignore the meta problem of the petition system, that is, the rights and functions contained in the letter and visit behavior. The right of suggestion and criticism belongs to the category of democratic supervision, and the accusation has the function of right relief besides the function of democratic supervision. The right to compensation itself is the core content of the right relief. The dual function of the petition behavior is quite different before and after the reform and opening up in 1978, with the formation and improvement of the socialist legal system with Chinese characteristics. The function of democratic supervision needs to be further strengthened, while the function of right relief needs to decline and disappear step by step, so as to realize the final separation of supervision and relief function. Let the petition system return to its democratic supervision track. This may be the direction of the petition system reform.
