【摘要】：華僑作為中國(guó)公民,其權(quán)益保護(hù)在憲法中有明確條文。但長(zhǎng)期以來(lái),由于種種原因,不論是在國(guó)外還是國(guó)內(nèi),華僑權(quán)益保護(hù)問(wèn)題并未得到足夠的重視,尤其是在國(guó)家立法層面,除了一部主要針對(duì)歸僑僑眷的《中華人民共和國(guó)歸僑僑眷權(quán)益保護(hù)法》之外,華僑的權(quán)益保護(hù)主要靠政策來(lái)調(diào)整,相關(guān)立法存在著明顯的缺位。在當(dāng)前全面推進(jìn)依法治國(guó)戰(zhàn)略部署的大背景下,本文從憲法中明確規(guī)定保護(hù)華僑權(quán)益的條文出發(fā),針對(duì)當(dāng)前相關(guān)立法存在著的明顯缺位,回應(yīng)華僑權(quán)益保護(hù)面臨的法治化要求。通過(guò)梳理相關(guān)概念,試圖厘清華僑、華僑權(quán)益、華僑權(quán)益保護(hù)、正當(dāng)性等概念的涵義,并對(duì)相關(guān)概念進(jìn)行比較分析,辨析其來(lái)源和不同歷史時(shí)期的指涉范圍及法律涵義;通過(guò)對(duì)憲法中相關(guān)規(guī)定和國(guó)際法有關(guān)原則的援引分析,探求華僑權(quán)益保護(hù)的法理正當(dāng)性;通過(guò)對(duì)保護(hù)華僑權(quán)益相關(guān)規(guī)定的歷史淵源進(jìn)行梳理,歸納探尋保護(hù)華僑權(quán)益的歷史正當(dāng)性;通過(guò)分析當(dāng)前華僑權(quán)益保護(hù)存在的實(shí)際問(wèn)題,闡述華僑權(quán)益保護(hù)的現(xiàn)實(shí)正當(dāng)性;通過(guò)同以色列、印度、愛(ài)爾蘭等國(guó)的僑民保護(hù)制度進(jìn)行比較,分析在當(dāng)前人才競(jìng)爭(zhēng)日趨激烈的大環(huán)境下保護(hù)華僑僑益的必要性、緊迫性和可行性。通過(guò)以上歸納、比較和綜合研究當(dāng)前保護(hù)華僑權(quán)益的正當(dāng)性問(wèn)題,本文探討華僑權(quán)益保護(hù)的法理價(jià)值,論述保護(hù)華僑權(quán)益的應(yīng)然性和必然性要求,最后提出保護(hù)尤其是通過(guò)立法保護(hù)華僑權(quán)益的意見(jiàn)和建議。
[Abstract]:As a Chinese citizen, the protection of the rights and interests of overseas Chinese is clearly stipulated in the Constitution. However, for a long time, for various reasons, whether at home or abroad, the protection of the rights and interests of overseas Chinese has not received sufficient attention, especially at the level of national legislation. In addition to a "Law of the people's Republic of China on the Protection of the Rights and interests of returned overseas Chinese and their families", the protection of the rights and interests of overseas Chinese is mainly adjusted by policies. Under the background of promoting the strategic arrangement of governing the country according to law in an all-round way, this paper sets out from the provisions of the Constitution to protect the rights and interests of overseas Chinese, aiming at the obvious absence of the current relevant legislation. In response to the legal requirements faced by the protection of the rights and interests of overseas Chinese. By combing the relevant concepts, this paper tries to clarify the meaning of the concepts of overseas Chinese, the rights and interests of overseas Chinese, the protection of the rights and interests of overseas Chinese, and legitimacy, and makes a comparative analysis of the related concepts. Through the analysis of the relevant provisions of the Constitution and the relevant principles of international law, this paper explores the legal legitimacy of the protection of the rights and interests of overseas Chinese. Through combing the historical origin of the relevant provisions on the protection of the rights and interests of overseas Chinese, this paper sums up the historical legitimacy of protecting the rights and interests of overseas Chinese, analyzes the practical problems existing in the protection of the rights and interests of overseas Chinese, and expounds the realistic legitimacy of the protection of the rights and interests of overseas Chinese. By comparing with the overseas Chinese protection system in Israel, India, Ireland and other countries, this paper analyzes the necessity, urgency and feasibility of protecting the interests of overseas Chinese under the increasingly fierce competition for talents. By comparing and synthetically studying the legitimacy of protecting the rights and interests of overseas Chinese at present, this paper discusses the legal value of the protection of the rights and interests of overseas Chinese, and discusses the necessity and inevitability of protecting the rights and interests of overseas Chinese. Finally, some suggestions and suggestions are put forward to protect the rights and interests of overseas Chinese, especially through legislation.
