【摘要】：轉基因技術是現(xiàn)代科學發(fā)展下的新興產物。近年來,全球人口劇增,環(huán)境劇烈變化,傳統(tǒng)糧食作物能做愈發(fā)困難。為應對糧食危機,先進大國開始研發(fā)轉基因技術對糧食作物進行改良,有效的增加了糧食產量。然而,轉基因技術并未沒有危險,轉基因作物除了可能會給環(huán)境生態(tài)與物種的多樣性帶來新的危害外,亦無法確保改造后對人體安全無憂。我國數(shù)千年間一直認同“民以食為天”,那么我國作為“國以民為本”的社會主義國家,自然應當對食品安全進行充分的重視,其中,隨著我國糧食壓力的不斷增強,能夠大幅度增加糧食產量的轉基因食品越來越多的出現(xiàn)在民眾的餐桌之上,為降低轉基因食品對自然環(huán)境、人體健康的安全風險,保護消費者應有的權益,完善轉基因食品法律規(guī)制稱為維護食品安全中的重要一環(huán)。筆者由于能力所限,無法對我國的轉基因食品立法獨立提出較多具有可行性的意見,本文更多的是對現(xiàn)有轉基因食品安全法律規(guī)制研究的梳理與整合以及對域外立法的歸納,對域外相對完善的立法經驗進行借鑒。文章分為四部分撰寫,第一部分對轉基因食品的概念以及轉基因食品的優(yōu)勢以及可能造成的風險進行介紹,做到對轉基因食品安全內容的心中有數(shù)。第二部分通過表格的方式梳理我國歷年來的轉基因食品立法內容與監(jiān)管方式,總結我國在轉基因食品安全法律規(guī)制以及監(jiān)管模式的不足之處。提出問題,等待后文的解決。第三部分通過比較研究的方式對美國、歐洲、日本的轉基因食品立法模式進行評價與學習,從中吸取能夠為我國所用的先進制度以及立法模式,為建立具有我國特色的轉基因食品立法體系提供素材。第四部分通過借鑒美、歐、日的成熟立法、監(jiān)管模式,在綜合考量我國國家利益、文化傳統(tǒng)、立法能力的基礎上建立具有我國特色的轉基因食品安全法律體系。
[Abstract]:Genetically modified technology is a new product of modern science. In recent years, the global population has increased dramatically, the environment has changed dramatically, and traditional food crops have become more difficult to do. Advanced countries have begun to develop genetically modified technology to improve grain crops, effectively increasing grain production. However, GM technology is not without danger. In addition to the potential for new hazards to environmental ecology and species diversity, genetically modified crops, Nor can we ensure that the human body will be safe after the transformation. For thousands of years, our country has always recognized that "the people take food as the sky." then, as a socialist country with "the country based on the people," we naturally should pay full attention to food safety, among which, With the increasing grain pressure in our country, more and more genetically modified foods which can greatly increase the grain output appear on the dining table of the people. In order to reduce the safety risks to the natural environment and human health caused by the genetically modified food, To protect the rights and interests of consumers and to perfect the legal regulation of genetically modified food is an important part of the maintenance of food safety. Due to the limitation of ability, the author is unable to put forward more feasible opinions on the legislative independence of genetically modified food in China. This article is more on the existing research on genetically modified food safety legal regulation and integration, as well as the induction of extraterritorial legislation, foreign relatively perfect legislative experience. The article is divided into four parts, The first part introduces the concept of GM food, its advantages and risks. The second part is to sort out the legislative content and supervision methods of GM food in China over the years by tabular way. This paper summarizes the deficiencies of the legal regulation and regulatory model of GM food safety in China. It raises questions and waits for the resolution of the following articles. The third part makes a comparative study of the United States, Europe, Europe and the United States. The legislative model of genetically modified food in Japan is evaluated and studied to draw on the advanced system and legislative model that can be used for our country, and to provide the material for the establishment of the legislation system of transgenic food with Chinese characteristics. The fourth part draws lessons from the United States. The mature legislation and supervision model of Europe and Japan, on the basis of comprehensive consideration of China's national interests, cultural traditions and legislative ability, establishes a legal system of genetically modified food safety with Chinese characteristics.
