【摘要】：在我國教育法律法規(guī)體系中,目前并未對教師懲戒權(quán)立法的內(nèi)涵外延及行使細(xì)則予以明確界定和規(guī)制,在實(shí)踐中而是由我國教育研究者給出了模糊的相關(guān)解釋和說明。在國外,許多國家法律中明文規(guī)定懲戒權(quán)是教師的專業(yè)權(quán)利之一,隸屬于教師職權(quán),與教師授課自由權(quán)、授課內(nèi)容編輯權(quán)、對學(xué)生的教育評價權(quán)及自身進(jìn)修權(quán)等,并列為教師可獨(dú)立行使的教育權(quán)利,并且教師懲戒權(quán)立法已有一定的實(shí)踐基礎(chǔ)。
[Abstract]:In the system of educational laws and regulations in our country, the connotation and extension of the legislation of teacher's punishment right and its exercise rules have not been clearly defined and regulated at present. In practice, some vague explanations and explanations have been given by the educational researchers in our country. In many foreign countries, the right to discipline is clearly stipulated in the laws of many countries as one of the professional rights of teachers, belonging to the authority of the teacher, the right to freedom of teaching, the right to edit the contents of the course, the right to evaluate the education of students and the right to self-improvement, and so on. It is also the right of education that teachers can exercise independently, and the legislation of teacher's right of punishment has a certain practical foundation.
