【摘要】：本文圍繞修法指導(dǎo)思想與修法目標(biāo)、法律名稱與調(diào)整范圍、以及聯(lián)合社成員制度規(guī)定等若干焦點(diǎn)、熱點(diǎn)問題,對(duì)《農(nóng)民專業(yè)合作社法》的修訂提出初步的意見。文章認(rèn)為,法律修訂應(yīng)以提升農(nóng)戶進(jìn)入市場(chǎng)的組織化程度、增加農(nóng)民收入,和促進(jìn)現(xiàn)代農(nóng)業(yè)經(jīng)營(yíng)主體創(chuàng)新、提升農(nóng)業(yè)市場(chǎng)競(jìng)爭(zhēng)力的雙重重任為目標(biāo)。法律名稱建議修訂為《農(nóng)民合作社法》,拓展法律的調(diào)整范圍,解決當(dāng)前農(nóng)民專業(yè)合作社發(fā)展中出現(xiàn)的名實(shí)不符和無(wú)法可依等兩大突出問題。聯(lián)合社成員制度的法律規(guī)定應(yīng)實(shí)行開放式成員制度,允許非合作社成員加入,以更好地服務(wù)合作社成員社,同時(shí)應(yīng)防止聯(lián)合社可能出現(xiàn)的區(qū)域性市場(chǎng)壟斷問題。
[Abstract]:This paper puts forward some preliminary opinions on the revision of the Law on Farmers' Professional Cooperatives, focusing on the guiding ideology and the goal of amending the Law, the legal name and the scope of adjustment, as well as the regulations of the membership system of the Union Society. The paper holds that the legal revision should aim at promoting the organization of farmers' entry into the market, increasing farmers' income, promoting the innovation of the main body of modern agricultural management and promoting the competitiveness of the agricultural market. The name of the law is proposed to be amended to the Law on Farmers' Cooperatives to expand the scope of the adjustment of the law and to solve the two outstanding problems in the development of the farmers' professional cooperatives, such as the discrepancy between the name and the fact and the inability to rely on it. The law of the membership system should adopt open membership system, allow non-cooperative members to join, so as to better serve the cooperative members, and prevent regional market monopoly problems that may arise in the union at the same time.
