我國質(zhì)詢權(quán)法律規(guī)范的問題分析及完善建議

【摘要】：人大監(jiān)督權(quán)的實(shí)現(xiàn)對于國家權(quán)力的有效運(yùn)轉(zhuǎn),人民權(quán)利的保障有著重要作用,而質(zhì)詢權(quán)作為監(jiān)督權(quán)的一種重要形式,無論是理論上還是實(shí)踐中,都沒有得到足夠的重視,從而也影響了質(zhì)詢權(quán)的實(shí)效發(fā)揮,不利于監(jiān)督權(quán)的實(shí)現(xiàn)。作為質(zhì)詢權(quán)實(shí)施最根本的依憑,質(zhì)詢權(quán)法律規(guī)范的完善與否對質(zhì)詢權(quán)運(yùn)行有著至關(guān)重要的作用,本文以我國質(zhì)詢權(quán)法律規(guī)范為中心,首先就質(zhì)詢權(quán)的概念、性質(zhì)、特點(diǎn)、功能、淵源和發(fā)展等作必要概述；其次是介紹了我國既有的質(zhì)詢權(quán)法律規(guī)范內(nèi)容,并從質(zhì)詢權(quán)實(shí)體規(guī)范層面存在的質(zhì)詢權(quán)需人大代表集體行使、質(zhì)詢案提起人數(shù)劃分不當(dāng)、質(zhì)詢權(quán)的內(nèi)容尚無規(guī)范、司法機(jī)關(guān)是否為質(zhì)詢對象、個人應(yīng)否作為質(zhì)詢對象五個方面來分析其問題,而程序規(guī)范層面則就提起質(zhì)詢案的時間限制、提起質(zhì)詢案的形式限制、質(zhì)詢答復(fù)程序規(guī)定過于籠統(tǒng)、質(zhì)詢?nèi)狈Y(jié)果程序這四個方面來分析其存在的問題；最后結(jié)合西方議會制國家的相關(guān)規(guī)定,針對上述問題建議分別從放寬提起質(zhì)詢的人數(shù)要求、增加質(zhì)詢權(quán)內(nèi)容的法律規(guī)范、明確司法機(jī)關(guān)和機(jī)關(guān)負(fù)責(zé)人作為質(zhì)詢權(quán)對象三方面來完善我國質(zhì)詢權(quán)的實(shí)體法律規(guī)范,而程序規(guī)范方面就啟動程序、答復(fù)程序、結(jié)果程序三方面來提出完善建議。
[Abstract]:The realization of the supervision power of the National people's Congress plays an important role in the effective operation of state power and the protection of the rights of the people, and the right of inquiry, as an important form of supervision power, has not been paid enough attention either in theory or in practice. Thus, it also affects the actual effect of the right of inquiry, which is not conducive to the realization of the power of supervision. As the most fundamental basis for the implementation of the right of inquiry, the perfection of the legal norms of the right of inquiry plays a vital role in the operation of the right of inquiry. This paper focuses on the legal norms of the right of inquiry in our country, first of all, on the concept, nature, characteristics and functions of the right of inquiry. Make a necessary summary of the origin and development; Secondly, it introduces the existing legal norms of the right of inquiry in our country, and from the level of the norms of the entity of the right of inquiry, the right of inquiry needs to be exercised collectively by the deputies to the National people's Congress, the number of cases raised is improperly divided, and the content of the right of inquiry is not yet standardized. Whether the judiciary is the object of questioning or not, whether individuals should analyze their problems as the object of inquiry, while at the level of procedural norms, the time limit for filing questions, the formal restrictions on filing questions, and the procedures for answering questions are too general. The lack of outcome procedure is used to analyze the existing problems. Finally, combined with the relevant provisions of the western parliamentary countries, in view of the above problems, it is suggested that the legal norms of the content of the right of inquiry should be increased by relaxing the requirements for the number of people asking questions. Make clear that the judicial organ and the person in charge of the organ as the object of inquiry right to improve the substantive legal norms of the right of inquiry in our country, and the procedural norms on the initiation of procedures, response procedures, results procedures to improve the three aspects of suggestions.
