【摘要】：農(nóng)民對土地權(quán)屬的認(rèn)定及其理由與法定產(chǎn)權(quán)存在差異,這種差異雖然體現(xiàn)了農(nóng)民的利益訴求,但其背后深層誘因更值得深思:農(nóng)民對確權(quán)文本和相關(guān)法規(guī)進(jìn)行了有利于自身的解釋,實現(xiàn)了自身的產(chǎn)權(quán)建構(gòu)。繼而從更深層觀之,農(nóng)民的產(chǎn)權(quán)認(rèn)知則成為產(chǎn)權(quán)建構(gòu)的社會文化基礎(chǔ)。這是農(nóng)民在土地利用中的約定俗成和歷史延續(xù)中塑成的,并與現(xiàn)行法律法規(guī)存在一定沖突。不過,農(nóng)民并未完全排斥國家法與確權(quán)文件,而是將其與地方性知識共同作為獲取利益的工具。農(nóng)村土地制度的實施與改革必須要充分考量農(nóng)民的生活實踐。
[Abstract]:There are differences between farmers' cognizance of land ownership and their reasons for their legal property rights, although this difference reflects the interests of farmers. However, the deep inducement behind it is more worth pondering: the peasants have explained the text of confirming the right and the relevant laws and regulations in favor of themselves, and realized the construction of their own property rights. Then, from a deeper point of view, farmers' awareness of property rights has become the social and cultural basis of property right construction. This is formed by farmers in the custom and historical continuation of land use, and there is a certain conflict with the current laws and regulations. However, farmers do not completely exclude the national law and power documents, but use it and local knowledge as a tool to obtain benefits. The implementation and reform of rural land system must fully consider the life practice of farmers.
