從我國現行政策看男性陪產假入法的可行性

【摘要】:男性陪產假,即男性在妻子生育時享受的一定時間的看護妻子、照料新生兒和家庭的假期,因為陪產假是基于女性生育的事實,依附于女性的產假,因此男性享受的這段假期稱之為"陪產假"。目前我國尚未有全國性的法律法規(guī)對陪產假作出相關規(guī)定,僅各省在《人口與計劃生育條例》中自主地規(guī)定了男性的陪產假或護理假及假期期間的薪資。但隨著"二孩"政策的全面開放、對《人口與計劃生育法》的修改以及我國對男女平等的堅持與貫徹,筆者認為將男性陪產假寫入法律是現實的,可行的。

At present, there are no national laws and regulations on paternity leave in our country. Only the provinces independently stipulate the paternity leave or nursing leave and the salary during the leave in the population and Family Planning regulations. However, with the comprehensive opening of the "two-child" policy, the revision of the population and Family Planning Law and the persistence and implementation of equality between men and women in our country, the author believes that it is realistic and feasible to write male paternity leave into the law.
