邊防檢查行政賠償問(wèn)題及對(duì)策的研究

【摘要】：隨著我國(guó)出入境邊防檢查法律體系的日益完善，出入境邊防檢查行政賠償制度也將會(huì)更加規(guī)范化。這就要求我們出入境邊防檢查機(jī)關(guān)及其工作人員一方面在行使檢查職權(quán)時(shí)，必須嚴(yán)格依法行政，切實(shí)保障出入境人員的合法權(quán)益，，另一方面在遇到出入境人員提起的行政賠償案件時(shí)，正確處理，在維護(hù)法律權(quán)威的同時(shí)使相對(duì)人的權(quán)益得到合理的保障�；诖耍ㄟ^(guò)以下出入境邊防檢查行政賠償?shù)臍w責(zé)原則、出入境邊防檢查行政賠償?shù)某绦�、出入境邊防檢查行政賠償?shù)膬?nèi)部追償?shù)葞追矫鏈\談出入境邊防檢查行政賠償制度存在的問(wèn)題并提出相應(yīng)的對(duì)策。
[Abstract]:With the improvement of the legal system of entry and exit border inspection in China, the administrative compensation system of entry and exit border inspection will be more standardized. This requires that, on the one hand, our entry and exit border inspection organs and their staff must strictly manage in accordance with the law and earnestly protect the legitimate rights and interests of entry and exit personnel in the exercise of inspection functions and powers. On the other hand, when the administrative compensation cases brought by entry and exit personnel are encountered, they should be dealt with correctly, so that the rights and interests of the counterpart can be reasonably protected while safeguarding the legal authority. Based on this, through the following principles of imputation of administrative compensation for border inspection at entry and exit, and procedures for administrative compensation for border inspection at entry and exit, This paper discusses the problems existing in the administrative compensation system of entry and exit border inspection and puts forward some corresponding countermeasures from several aspects, such as the internal recovery of administrative compensation for entry and exit border inspection.
