【摘要】：我國(guó)政府優(yōu)先購(gòu)買(mǎi)權(quán)制度實(shí)效缺失的主要原因在于其功能定位有偏差。其核心功能本應(yīng)是"輔助規(guī)劃實(shí)施、實(shí)現(xiàn)公共利益、重置土地發(fā)展權(quán)以及公平分配土地增值收益",但現(xiàn)行立法以"明顯低于市場(chǎng)價(jià)格"作為其要件,極大地限制了其作用空間。為充分發(fā)揮政府優(yōu)先購(gòu)買(mǎi)權(quán)特有的制度功能,應(yīng)當(dāng)在制度上轉(zhuǎn)型和重構(gòu):建立特定規(guī)劃發(fā)展區(qū)域的政府優(yōu)先購(gòu)買(mǎi)權(quán);將政府優(yōu)先購(gòu)買(mǎi)權(quán)的客體由土地?cái)U(kuò)展至不動(dòng)產(chǎn);放寬政府優(yōu)先購(gòu)買(mǎi)不動(dòng)產(chǎn)的價(jià)格限定;優(yōu)化政府優(yōu)先購(gòu)買(mǎi)權(quán)的實(shí)施機(jī)制;強(qiáng)化對(duì)政府優(yōu)先購(gòu)買(mǎi)權(quán)的自由裁量約束和外部監(jiān)督。在此基礎(chǔ)上,實(shí)現(xiàn)政府優(yōu)先購(gòu)買(mǎi)權(quán)與不動(dòng)產(chǎn)征收、土地收回、土地收購(gòu)等制度的功能互補(bǔ),進(jìn)一步健全我國(guó)土地利用管制制度體系。
[Abstract]:The main reason for the lack of the effectiveness of the government preemptive right system in our country lies in the deviation of its functional orientation. Its core function should have been "auxiliary planning and implementation, realization of public interest, replacement of land development right and fair distribution of land value-added benefits", but the current legislation takes "obviously lower than market price" as its essential element. It greatly limits its space of action. In order to give full play to the unique institutional function of the government preemptive right, we should transform and reconstruct the system: establish the government preemptive right in the specific planning and development area, extend the object of the government preemptive right from land to real estate, and extend the object of the government preemptive right from land to real estate. We should relax the price limit of government preemptive real estate, optimize the implementation mechanism of government preemptive right, and strengthen the discretion and external supervision of government preemptive right. On this basis, the government preemptive right and real estate expropriation, land resumption, land acquisition and other systems complement each other, and further improve the land use control system in our country.
