【摘要】：生態(tài)文明建設(shè)是一項(xiàng)重要且復(fù)雜的工程,需要法制強(qiáng)有力的保障。在民族地區(qū)生態(tài)文明建設(shè)過程中,法制有利于生態(tài)文明建設(shè)理念制度化、長期化和保障少數(shù)民族群眾生態(tài)權(quán)益,但也存在著生態(tài)文明立法不健全、生態(tài)環(huán)境執(zhí)法不力、司法介入存在制度缺失等一系列問題。在總結(jié)一些民族地區(qū)生態(tài)文明建設(shè)法制保障經(jīng)驗(yàn)的基礎(chǔ)上,提出完善民族地區(qū)生態(tài)文明建設(shè)法制路徑的構(gòu)想:建立和完善生態(tài)文明法律體系,加強(qiáng)生態(tài)文明執(zhí)法力度,健全司法機(jī)制,進(jìn)而有力保障民族地區(qū)生態(tài)文明建設(shè)的順利推進(jìn)。
[Abstract]:The construction of ecological civilization is an important and complex project, which requires strong legal system. In that course of the construction of the ecological civilization in the national area, the rule of law is conducive to the institutionalization of the idea of the construction of the ecological civilization, the long-term and the guarantee of the ecological interest of the minority, but there are a series of problems such as the unsound legislation of the ecological civilization, the weak law enforcement of the ecological environment and the lack of the system of judicial intervention. On the basis of summarizing the experience of the legal protection of the ecological civilization in some ethnic regions, the paper puts forward the idea of improving the legal path of the ecological civilization construction in the national area: to establish and perfect the legal system of the ecological civilization, to strengthen the law enforcement of the ecological civilization and to improve the judicial mechanism. And further, the smooth progress of the construction of the ecological civilization in the national area is strongly guaranteed.
