【摘要】：域名是網(wǎng)絡環(huán)境下的新生事物，信息技術高速發(fā)展，導致人們很難把握其發(fā)展規(guī)律，對其法律保護更是難以形成統(tǒng)一的認識。現(xiàn)階段，我國有關域名爭議方面的法律制度還較為落后，很多觀點還處于討論階段，并沒有定論。因此，對域名的法律問題進行研究是很有必要的。 本文從域名的概念出發(fā)，分析域名的功能及其價值，探討域名的法律屬性，得出域名屬于知識產(chǎn)權客體的結論。并通過具體案例歸納出域名爭議的類型，分析產(chǎn)生域名爭議的原因，從而得出確立域名權的必要性。由于互聯(lián)網(wǎng)域名的國際性，通過對美國、日本及國際組織域名保護進行分析，梳理出值得我國借鑒的經(jīng)驗。通過分析我國域名保護的立法現(xiàn)狀和司法實踐，，梳理我國域名爭議解決的現(xiàn)狀，從而總結出其中存在的問題。在本文的最后，針對文章前面部分提出的問題，借鑒國外有關經(jīng)驗，提出我國域名保護法律制度的完善路徑。
[Abstract]:The domain name is a new thing under the network environment , the high - speed development of information technology leads to the difficulty of grasping the law of development , and it is difficult to form a unified understanding of its legal protection . At the present stage , the legal system of domain name dispute in our country is still relatively backward , and many views are still in the discussion stage , and there is no theory . Therefore , it is necessary to study the legal problems of domain name .

Based on the concept of domain name , this paper analyzes the function of domain name and its value , discusses the legal property of domain name , and concludes that domain name belongs to intellectual property object .
