【摘要】：在這個(gè)“設(shè)計(jì)創(chuàng)造財(cái)富”的時(shí)代，產(chǎn)品的外觀設(shè)計(jì)最直觀、具體、貼近廣大消費(fèi)者和企業(yè)。消費(fèi)者越來(lái)越追求美和個(gè)性，促使外觀設(shè)計(jì)成為其購(gòu)買產(chǎn)品的決定性因素，從而是實(shí)現(xiàn)產(chǎn)品的價(jià)值、占領(lǐng)市場(chǎng)的決定性因素。又由于外觀設(shè)計(jì)獲得保護(hù)的程序簡(jiǎn)單、成本投入較低，維護(hù)成本低廉更加貼切商品經(jīng)濟(jì)時(shí)代產(chǎn)品更新速度快的特點(diǎn)，各個(gè)國(guó)家無(wú)不將其作為重要的國(guó)家發(fā)展戰(zhàn)略。但是工業(yè)品外觀設(shè)計(jì)兼跨藝術(shù)和產(chǎn)業(yè)兩大領(lǐng)域，它既屬于工業(yè)產(chǎn)品的新設(shè)計(jì)，能夠受到專利法的保護(hù)；同時(shí)它是設(shè)計(jì)師具有獨(dú)創(chuàng)性的智力成果，可以得到著作權(quán)法的保護(hù)。外觀設(shè)計(jì)介于專利權(quán)和著作權(quán)之間，兩個(gè)獨(dú)立領(lǐng)域在實(shí)踐中產(chǎn)生了交叉。而我國(guó)知識(shí)產(chǎn)權(quán)法律體系，似乎面面俱到，實(shí)則細(xì)密不足，，疏闊有余。加之法官之間、法院之間、法院與專利復(fù)審委之間、官方與學(xué)者間對(duì)于外觀設(shè)計(jì)專利法的理解不同，造成同類案件，法律適用的結(jié)果迥異，而其中也暴露出我們目前司法中所面臨的問(wèn)題。 本文共分六個(gè)章節(jié)，第一部分為緒論部分。第二部分從工業(yè)品外觀設(shè)計(jì)的司法典型案例中，分析工業(yè)品外觀設(shè)計(jì)的司法現(xiàn)狀，從中剖析出司法實(shí)踐中所碰到的難題。第三部分：闡述了工業(yè)品外觀設(shè)計(jì)概念法律化過(guò)程，以及工業(yè)品外觀設(shè)計(jì)的概念、以及其與美術(shù)作品、實(shí)用藝術(shù)作品之間的關(guān)系。第四部分：是本文的重點(diǎn)章節(jié)，從理論和現(xiàn)實(shí)的角度對(duì)工業(yè)品外觀設(shè)計(jì)專利法與著作權(quán)法重合的情形進(jìn)行了分類，然后從理論的角度出發(fā)，分析工業(yè)品外觀設(shè)計(jì)的新穎性標(biāo)準(zhǔn)與著作權(quán)的獨(dú)創(chuàng)性標(biāo)準(zhǔn)的不同，從外觀設(shè)計(jì)產(chǎn)品是不是著作權(quán)作品的復(fù)制的角度，探討著作權(quán)法保護(hù)與專利法保護(hù)客體的重合。第五部分：對(duì)國(guó)外關(guān)于工業(yè)品外觀設(shè)計(jì)保護(hù)制度的介紹與評(píng)介。第六部分：對(duì)于現(xiàn)行機(jī)制下所產(chǎn)生的問(wèn)題，進(jìn)行工業(yè)品外觀設(shè)計(jì)單純立法的可行性進(jìn)行了否定，然后通過(guò)對(duì)工業(yè)品外觀設(shè)計(jì)與著作權(quán)重合的不同情形采取了不同的保護(hù)模式，對(duì)完善現(xiàn)行解決機(jī)制提出一點(diǎn)自己的見解。
[Abstract]:In this "design to create wealth" era, product design is the most intuitive, specific, close to the majority of consumers and enterprises. Consumers are more and more pursuing beauty and personality, which makes appearance design become the decisive factor for them to buy products, which is the decisive factor to realize the value of products and occupy the market. Because of the simple procedure of protecting appearance design, low cost, low maintenance cost and fast updating speed of products in the age of commodity economy, every country regards it as an important national development strategy. However, industrial appearance design is not only a new design of industrial products and can be protected by patent law, but also a creative intellectual achievement of designers, which can be protected by copyright law. The design is between patent and copyright, and the two independent fields are intersected in practice. But our country intellectual property law system, seems to have all sides, in fact is detailed insufficient, sparse has more than. In addition, there are different understandings of the design patent law between the judges, the courts, the courts and the Patent Review Board, and between the officials and the scholars, resulting in different results of the application of the law in similar cases. And also exposed our current problems in the administration of justice. This paper is divided into six chapters, the first part is the introduction. The second part analyzes the judicial status of industrial design from the typical cases of industrial design, from which the problems encountered in judicial practice are analyzed. The third part: elaborated the industrial product appearance design concept legal process, as well as the industrial product appearance design concept, as well as its and the fine arts work, the practical art work relations. The fourth part: this article is the key chapter, from the theory and the reality angle, has carried on the classification to the industrial product appearance design patent law and the copyright law superposition, then from the theory angle, This paper analyzes the difference between the novelty standard of industrial design and the originality standard of copyright, and discusses the coincidence between copyright law protection and patent law protection object from the point of view of whether the design product is a copy of copyright work. Part V: introduction and review on the protection system of industrial design abroad. The sixth part: for the problems arising under the current mechanism, the feasibility of pure legislation of industrial product design is negated, and then different protection modes are adopted through the different cases of industrial design and copyright coincidence. To perfect the present solution mechanism puts forward own opinion.
