【摘要】：少數(shù)民族文化知識產(chǎn)權(quán)保護對于少數(shù)民族傳統(tǒng)文化的保存、延續(xù)和發(fā)展具有非常重要的作用。無論是國際條約還是其他國家,都有很多關(guān)于少數(shù)民族文化知識產(chǎn)權(quán)保護的相關(guān)立法可資借鑒。由于傳統(tǒng)知識財產(chǎn)權(quán)與少數(shù)民族文化知識產(chǎn)權(quán)之間有比較大的隔閡,運用傳統(tǒng)知識財產(chǎn)權(quán)無法完全保護少數(shù)民族文化,因此建議對少數(shù)民族文化知識產(chǎn)權(quán)保護進行特別立法。
[Abstract]:The protection of intellectual property rights plays an important role in the preservation, continuation and development of minority traditional culture. Whether international treaties or other countries, there are a lot of relevant legislation on the protection of minority cultural intellectual property rights can be used for reference. Because there is a big gap between traditional intellectual property rights and minority cultural intellectual property rights, the use of traditional intellectual property rights can not fully protect minority cultures, so it is suggested that special legislation should be made on the protection of minority cultural intellectual property rights.
