【摘要】：“民以食為天,食以安為先”,食品安全自古以來(lái)都是極其重視的問(wèn)題,在生活水平大幅度提高的今天更是如此。但是近年來(lái)各種濫用食品添加劑導(dǎo)致的食品安全事件頻頻出現(xiàn),比如上�！叭旧�饅頭”事件、沈陽(yáng)“毒豆芽”事件、雙匯“瘦肉精”事件及“蘇丹紅”鴨蛋事件等。一時(shí)之間,大家都在問(wèn)“我們現(xiàn)在到底吃什么才是安全的”,引發(fā)全體國(guó)民深思。層出不窮的食品安全事件折射出食品添加劑濫用的嚴(yán)重性。食品添加劑是食品工業(yè)不可或缺的部分,其安全使用關(guān)乎整個(gè)食品產(chǎn)業(yè)鏈的安全。因此,加強(qiáng)食品添加劑的安全規(guī)制是確保食品安全的必要途徑。食品添加劑是影響食品安全的首要因素,現(xiàn)階段很多的食品安全事件是由超限量、超范圍使用食品添加劑或使用非法添加物所導(dǎo)致,這也決定了食品添加劑的安全規(guī)制不同于食品安全規(guī)制。如何更好地對(duì)食品添加劑濫用及違法添加非食用物質(zhì)現(xiàn)象進(jìn)行預(yù)防打擊,怎樣完善我國(guó)食品添加劑安全規(guī)制體制,是本文想要回答的問(wèn)題。文章運(yùn)用博弈論的方法,基于經(jīng)濟(jì)學(xué)視角深入剖析了我國(guó)食品添加劑安全規(guī)制失靈的原因,即企業(yè)違法犯罪成本太小、規(guī)制人員積極規(guī)制的激勵(lì)不足及社會(huì)第三方監(jiān)督體系不完善。文章主要分為七個(gè)部分。首先,介紹了論題研究背景、意義及方法。其次,對(duì)食品添加劑安全規(guī)制的國(guó)內(nèi)外研究文獻(xiàn)進(jìn)行綜述。再次,分析了食品添加劑安全規(guī)制的相關(guān)理論,并結(jié)合食品添加劑產(chǎn)業(yè)鏈進(jìn)行分析。然后,深入探討了我國(guó)食品添加劑安全規(guī)制現(xiàn)狀及存在的主要問(wèn)題。接著,構(gòu)建了食品添加劑安全規(guī)制行為主體間的靜態(tài)與動(dòng)態(tài)博弈模型,具體分析我國(guó)食品添加劑安全規(guī)制失靈的原因。另外,將國(guó)外發(fā)達(dá)國(guó)家食品添加劑安全規(guī)制的成功經(jīng)驗(yàn)進(jìn)行了比較分析,并總結(jié)出完善我國(guó)食品添加劑安全規(guī)制的可借鑒之處。最后從法律健全、標(biāo)準(zhǔn)建設(shè)、規(guī)制部門整合、第三方監(jiān)督及企業(yè)自我規(guī)制五個(gè)方面提出相應(yīng)的對(duì)策建議。
[Abstract]:Food safety has been an issue of great importance since ancient times, especially today when people's living standards have been greatly improved. But in recent years, many kinds of food safety incidents caused by the abuse of food additives, such as Shanghai "dyed steamed bread" incident, Shenyang "toxic bean sprouts" incident, Shuanghui "lean meat essence" incident and "Sudan red" duck egg incident, etc. For a moment, we all asked, "what are we eating now is safe", causing the whole nation to ponder. The endless food safety incidents reflect the seriousness of the abuse of food additives. Food additive is an indispensable part of food industry, its safe use is related to the safety of the whole food industry chain. Therefore, to strengthen the safety regulation of food additives is the necessary way to ensure food safety. Food additives are the primary factors affecting food safety. At this stage, many food safety incidents are caused by the excessive use of food additives or the use of illegal additives. This also determines that food additive safety regulation is different from food safety regulation. How to better prevent the abuse of food additives and the illegal addition of non-edible substances, and how to improve the safety regulation system of food additives in China, is the question this paper wants to answer. Based on the method of game theory, this paper analyzes the reasons for the failure of food additive safety regulation in China, that is, the cost of illegal crime is too small. The regulation staff actively regulated the incentive insufficiency and the social third-party supervision system is not perfect. The article is divided into seven parts. Firstly, the background, significance and methods of the research are introduced. Secondly, the domestic and foreign literatures on food additive safety regulation are reviewed. Thirdly, the related theory of food additive safety regulation is analyzed, and the food additive industry chain is analyzed. Then, the present situation and main problems of food additive safety regulation in China are discussed. Then, the static and dynamic game models between the actors of food additive safety regulation are constructed, and the reasons for the failure of food additive safety regulation in China are analyzed. In addition, the successful experiences of food additive safety regulation in developed countries are compared and analyzed, and the reference points of perfecting food additive safety regulation in China are summarized. Finally, the corresponding countermeasures and suggestions are put forward from five aspects: perfect law, standard construction, regulation department integration, third party supervision and enterprise self-regulation.
