跨國汽車公司在華專利戰(zhàn)略與我國汽車企業(yè)的應對

【摘要】:我國汽車市場保持高速增長,成為跨國汽車公司最重要的市場?鐕嚬驹谶M入我國市場之時或之前就針對我國汽車市場制定了完善的專利戰(zhàn)略。由于我國汽車企業(yè)的專利保護起步較晚,意識薄弱,專利管理水平低下導致與跨國汽車公司的專利戰(zhàn)中處于劣勢地位。 本文通過對汽車公司大量專利數據的搜集與整理,從跨國汽車公司、合資汽車公司和我國汽車企業(yè)專利申請量、專利種類、技術領域各個方面進行分析和預測,將跨國汽車公司與我國汽車企業(yè)的專利申請數據進行比較,指出我國汽車企業(yè)專利申請落后于跨國汽車公司的原因。本文總結跨國汽車公司在華專利戰(zhàn)略的總體特征,依托自身資源優(yōu)勢獲取盡可能多的基本專利、控制合資企業(yè)專利數量并發(fā)起專利訴訟、新能源汽車研發(fā)成技術爭奪點;并以豐田公司為例分析跨國汽車公司在華實施的基本專利戰(zhàn)略、專利網戰(zhàn)略和專利訴訟戰(zhàn)略,打壓我國汽車企業(yè)的自主創(chuàng)新的戰(zhàn)略運用;從有利影響和不利影響兩個方面分析跨國汽車企業(yè)在我國實施專利戰(zhàn)略的影響。本文運用PEST(政治環(huán)境、經濟環(huán)境、社會環(huán)境、技術環(huán)境)分析模型對中國汽車行業(yè)的宏觀環(huán)境進行分析,提出我國汽車企業(yè)應綜合運用取消對方專利戰(zhàn)略、交叉許可戰(zhàn)略、利用失效專利戰(zhàn)略、專利回輸戰(zhàn)略和專利訴訟應對戰(zhàn)略,以求在專利戰(zhàn)中后發(fā)制人,,贏得未來市場。
[Abstract]:China's auto market has maintained a high growth rate, The multinational automobile company has made a perfect patent strategy for our automobile market before or when it entered the market. Because of the late start of patent protection and the weak consciousness of the automobile enterprises in our country, it has become the most important market for the multinational automobile companies. The low level of patent management leads to a disadvantage in the patent war with multinational automobile companies. Based on the collection and collation of a large number of patent data of automobile companies, this paper analyzes and forecasts the amount of patent applications, types of patents, and technical fields of multinational automobile companies, joint-venture automobile companies and Chinese automobile enterprises. By comparing the patent application data between multinational automobile companies and Chinese automobile enterprises, this paper points out the reasons why Chinese automobile companies lag behind in patent applications. This paper summarizes the overall characteristics of the patent strategy of multinational automobile companies in China. Relying on their own advantages of resources to obtain as many basic patents as possible, control the number of joint ventures patents and initiate patent litigation, new energy vehicle research and development into technology competition point; Taking Toyota as an example, this paper analyzes the basic patent strategy, patent network strategy and patent litigation strategy implemented by multinational automobile companies in China to suppress the strategic application of independent innovation of Chinese automobile enterprises. This paper analyzes the impact of multinational automobile enterprises' patent strategy in China from two aspects: favorable influence and negative impact. This paper uses pest (political environment, economic environment, social environment). The technical environment) analysis model analyzes the macro environment of China's automobile industry, and points out that Chinese automobile enterprises should comprehensively use the strategy of cancelling the other party's patent, cross-licensing strategy, and utilizing the strategy of invalidation of patent. Patent return strategy and patent litigation strategy in order to win the future market.
