【摘要】：對壽險保單持有人的保護是世界各國問題保險公司或經(jīng)營失敗保險公司處置中的保障重點。保險市場退出對保單持有人權益的影響包括權利受到侵害、保障額度降低、保險范圍變化、清算程序帶來不利影響、所享待遇降低等。保險市場退出環(huán)境下完善保單持有人權益保護的對策包括:在保險人失去清償能力前,應采用動態(tài)的償付能力監(jiān)管措施,引導大眾對風險有所了解,事先樹立債權人的正確意識;在保險人失去清償能力后,應強化保險保障基金的正確管理,完善破產(chǎn)后的告知義務,給予壽險消費者更多的權利,對清償?shù)牡谝豁樞蛉藨�設置限額。
[Abstract]:The protection of life insurance policy holders is the key point in the disposal of problem insurance companies or failure insurance companies all over the world. The impact of insurance market withdrawal on the rights and interests of policy holders includes the infringement of rights, the reduction of the amount of protection, the change of insurance coverage, the adverse effects of liquidation procedures, and the reduction of benefits enjoyed by policy holders. The countermeasures to improve the protection of the rights and interests of policy holders under the environment of withdrawal from the insurance market include: before the insurer loses its solvency, it should adopt dynamic solvency supervision measures to guide the public to understand the risks. After the insurer loses its ability to pay off, it is necessary to strengthen the correct management of the insurance protection fund, perfect the obligation of informing after bankruptcy, and give more rights to the life insurance consumers. A limit shall be set for the first order person to pay off.
