【摘要】：傳統(tǒng)手工藝是人民群眾在漫長的歷史發(fā)展過程中創(chuàng)造出來的智慧成果，是民族傳統(tǒng)文化的重要組成部分，具有突出的文化價值和經(jīng)濟價值。近年來，隨著全球化趨勢的加強和現(xiàn)代化進程的加快，許多技藝瀕臨滅絕，加之過度開發(fā)、隨意濫用現(xiàn)象泛濫，傳統(tǒng)手工藝面臨著嚴峻的生存危機。傳統(tǒng)手工藝不斷消失，其所蘊含的民族精神以及所體現(xiàn)民族個性也會隨之消失。因此，對傳統(tǒng)手工藝進行保護已成為相關(guān)國際組織、各國政府和學(xué)術(shù)界所關(guān)注的、迫切需要解決的問題。 在我國，保護傳統(tǒng)手工藝的立法比較零散，，且多是行政法規(guī)和規(guī)章，民事保護尤其是知識產(chǎn)權(quán)保護基本缺位，2011年2月通過的《中華人民共和國非物質(zhì)文化遺產(chǎn)法》對其知識產(chǎn)權(quán)保護也只做了銜接性規(guī)定。在此背景下，本文選擇傳統(tǒng)手工藝知識產(chǎn)權(quán)保護為研究主題，參考國外立法，并結(jié)合我國實際情況，對如何有效保護傳統(tǒng)手工藝知識產(chǎn)權(quán)提出一些淺薄意見，以期對我國立法和司法實踐有所裨益。同時，也希望通過對這一課題的探討，強化我們保護非物質(zhì)文化遺產(chǎn)的意識，進而保護和促進民族傳統(tǒng)文化和世界文化多樣性的發(fā)展。 通過從理論層面對傳統(tǒng)手工藝及知識產(chǎn)權(quán)保護的基本理論問題進行探討，從實證層面對國際組織、外國和我國傳統(tǒng)手工藝保護的現(xiàn)狀與利弊得失進行評析，并在此基礎(chǔ)上提出構(gòu)建我國傳統(tǒng)手工藝知識產(chǎn)權(quán)保護的建議：根據(jù)目前的實際情況，最有效的途徑是運用現(xiàn)有的法律資源對傳統(tǒng)手工藝進行保護，即在現(xiàn)階段將傳統(tǒng)手工藝納入現(xiàn)行知識產(chǎn)權(quán)體系中，運用專利、商標、著作權(quán)以及反不正當(dāng)競爭制度進行綜合保護，同時通過對現(xiàn)有知識產(chǎn)權(quán)體系進行改造調(diào)整或制度創(chuàng)新，消除對傳統(tǒng)手工藝保護不力的因素，塑造一個有利于傳統(tǒng)手工藝傳承與發(fā)展的法律環(huán)境，待條件成熟后再建立我國傳統(tǒng)手工藝保護的特殊法。
[Abstract]:The traditional handicraft is the wisdom achievement created by the people in the long historical development process. It is an important part of the national traditional culture and has outstanding cultural value and economic value. In recent years, with the trend of globalization and the acceleration of the modernization process, many skills are on the verge of extinction, coupled with excessive development, indiscriminate abuse, traditional handicrafts are facing a severe survival crisis. With the disappearance of traditional handicraft, the national spirit and national personality will disappear. Therefore, the protection of traditional handicrafts has become an urgent problem to be solved by relevant international organizations, governments and academia. In China, legislation to protect traditional handicrafts is fragmented, and mostly administrative laws and regulations. Civil protection, especially intellectual property protection, is basically absent. The Law of the people's Republic of China on Intangible Cultural Heritage passed in February 2011 only provides for the protection of intellectual property rights. Under this background, this article chooses the traditional handicraft intellectual property protection as the research topic, consults the foreign legislation, and combines the actual situation of our country, puts forward some shallow opinions on how to effectively protect the traditional handicraft intellectual property right. In order to benefit our legislation and judicial practice. At the same time, we also hope to strengthen our consciousness of protecting intangible cultural heritage through the discussion of this subject, and then to protect and promote the development of national traditional culture and the cultural diversity of the world. This paper discusses the basic theoretical issues of traditional handicraft and intellectual property protection from the theoretical level, and evaluates the current situation, advantages and disadvantages of international organizations, foreign countries and China on the protection of traditional handicrafts from the perspective of empirical analysis. On this basis, the author puts forward some suggestions on how to protect the intellectual property rights of traditional handicraft: according to the actual situation, the most effective way is to protect the traditional handicraft by using the existing legal resources. That is, to bring traditional handicraft into the current intellectual property system at the present stage, to use patent, trademark, copyright and anti-unfair competition system for comprehensive protection, and at the same time, to reform and adjust the existing intellectual property system or to innovate the system. To eliminate the factors of weak protection of traditional handicrafts, to create a legal environment conducive to the inheritance and development of traditional handicrafts, and to establish a special law for the protection of traditional handicrafts in our country after the conditions are ripe.
