【摘要】：與私有制下土地作為純粹財產(chǎn)對象不同,公有土地不僅是農(nóng)業(yè)生產(chǎn)要素,而且具有重要的社會功能。彌合地權(quán)配置中公共原則與私人原則之間的沖突是設(shè)置我國農(nóng)地制度的難點(diǎn)。片面強(qiáng)化個體農(nóng)戶承包經(jīng)營權(quán)而虛化集體所有權(quán)的農(nóng)村土地制度改革,最終造成既不公平又無效率的地權(quán)配置結(jié)果。與之相比,國有農(nóng)場在地權(quán)制度安排中凸顯土地的公有屬性,在提高土地利用效率和促進(jìn)社會公平兩個方面都存在優(yōu)勢。針對當(dāng)前農(nóng)村地權(quán)配置矛盾,中央提出"三權(quán)分置"的改革思路,落實(shí)該項(xiàng)改革的關(guān)鍵是尊重集體所有權(quán),并在此基礎(chǔ)上作出合適的產(chǎn)權(quán)制度安排。與之相關(guān)的《農(nóng)村土地承包法》修訂,也需要從土地公有制出發(fā),兼顧私權(quán)保護(hù)和社會效益最大化。
[Abstract]:Different from the private ownership of land as a pure property object, public land is not only a factor of agricultural production, Moreover, it has important social function. Bridging the conflict between public and private principles in the allocation of land rights is the difficulty of setting up the agricultural land system in China. As a result, the allocation of land rights is unfair and inefficient. In contrast, the state-owned farms in the arrangement of land ownership system highlight the public attributes of the land. There are advantages in improving the efficiency of land use and promoting social equity. In view of the contradiction of the allocation of land rights in rural areas at present, the central government has put forward the reform idea of "three rights divided", and the key to the implementation of this reform is to respect collective ownership. On the basis of this, it is necessary to make appropriate arrangement of property right system. The revision of Rural Land contract Law, which is related to it, also needs to take into account the protection of private rights and the maximization of social benefits from the perspective of public ownership of land.
