沈陽(yáng)市信訪制度變遷研究

【摘要】：當(dāng)代中國(guó)的政治經(jīng)濟(jì)體制、利益格局和思想觀念都較之以前產(chǎn)生了變化。社會(huì)的矛盾、沖突等一系列問(wèn)題是社會(huì)發(fā)展的必然結(jié)果。人們一般會(huì)通過(guò)信訪以保護(hù)個(gè)人的權(quán)益。因?yàn)樾旁L的表達(dá)途徑更直接,成本更低廉的緣故。近年來(lái),信訪工作遇到了難題。地方政府的信訪部門(mén)的工作是作為全國(guó)信訪系統(tǒng)的基礎(chǔ)而被視為十分重要的。信訪制度的設(shè)計(jì)是否成功影響著基層社會(huì)與整個(gè)社會(huì)大環(huán)境的關(guān)系。在我國(guó)社會(huì)主義建設(shè)過(guò)程中,信訪被設(shè)計(jì)成社會(huì)的“安全閥”,起到一種把政府與公民聯(lián)系起來(lái)的橋梁的作用。信訪作為社會(huì)及公民維護(hù)權(quán)益的方便途徑,在國(guó)家轉(zhuǎn)型和變遷時(shí)出現(xiàn)的不均衡現(xiàn)象中有著十分重要的功能。轉(zhuǎn)變當(dāng)中社會(huì)問(wèn)題和矛盾大量的突顯出來(lái),這使信訪工作的重心放在了維護(hù)社會(huì)安定團(tuán)結(jié)之上。在近六十年的歷程當(dāng)中中國(guó)不斷改革深化,經(jīng)濟(jì)的不斷轉(zhuǎn)型,利益結(jié)構(gòu)的變革。對(duì)信訪制度進(jìn)行完善改革是十分必要的。信訪有著實(shí)現(xiàn)公民的政治參與、表達(dá)民意、處理矛盾、保障權(quán)益和維持穩(wěn)定的作用。一個(gè)制度的變遷是受一個(gè)社會(huì)的經(jīng)濟(jì)、政治和制度本身的內(nèi)部要求等多種要素導(dǎo)致的。本文分析了沈陽(yáng)市信訪部門(mén)的制度變革的過(guò)程,以諾斯的制度變遷理論為研究的支撐框架,通過(guò)把沈陽(yáng)市信訪制度變遷作為研究的對(duì)象入手,綜合運(yùn)用多種方法手段,深入探析沈陽(yáng)市信訪部門(mén)的制度變遷的歷程,對(duì)沈陽(yáng)市信訪部門(mén)在其制度變遷中出現(xiàn)的難題困境進(jìn)行了研究探討,并引出了解決的對(duì)策。從而給以后制度進(jìn)一步的完善變遷趨勢(shì)做出預(yù)測(cè)。本文分為五個(gè)部分:第一部分為緒論,主要內(nèi)容是論述論文研究的相關(guān)背景與意義、國(guó)內(nèi)外的研究狀況和論文研究方法及創(chuàng)新點(diǎn)。第二部分則主要介紹制度方面的概念,制度變遷理論的內(nèi)涵和研究模型,為下文做好理論鋪墊。第三部分介紹了沈陽(yáng)市信訪部門(mén)的制度變遷的歷程及沈陽(yáng)市信訪部門(mén)制度變遷中出現(xiàn)的困境與難題。第四部分論述了沈陽(yáng)市信訪制度變遷過(guò)程中存在問(wèn)題的原因進(jìn)行了探究。第五部分提出了解決沈陽(yáng)市信訪部門(mén)的制度變遷中問(wèn)題的相關(guān)對(duì)策。為了維護(hù)國(guó)家及社會(huì)的穩(wěn)步發(fā)展,信訪部門(mén)的設(shè)置就是對(duì)保證百姓的生活安穩(wěn)起著非常重要的影響。但由于社會(huì)正處于不斷的轉(zhuǎn)型時(shí)期,信訪工作作為整體系統(tǒng)的一部分,要與時(shí)俱進(jìn)的不斷革新跟上社會(huì)進(jìn)步的步伐。信訪的制度的設(shè)計(jì)的合理化這對(duì)社會(huì)的發(fā)展有著無(wú)可替代的至關(guān)重要的角色。沈陽(yáng)市當(dāng)前的信訪制度應(yīng)該多學(xué)習(xí)借鑒國(guó)外相關(guān)類似信訪制度的經(jīng)驗(yàn)和優(yōu)勢(shì)并結(jié)合當(dāng)前我國(guó)社會(huì)現(xiàn)狀,全面完善信訪工作機(jī)制,使信訪工作為人民的幸福生活服務(wù)的更好。
[Abstract]:Contemporary China's political and economic system, the pattern of interests and ideas have changed compared with the past. A series of problems, such as social contradictions and conflicts, are the inevitable result of social development. People usually use letters to protect their rights and interests. Because letters and visits are expressed more directly and more cheaply. In recent years, letters and visits have encountered difficulties. The work of the local government's petition department is considered very important as the foundation of the national petition system. The successful design of the petition system affects the relationship between the grassroots society and the whole social environment. In the process of socialist construction in China, letters and visits are designed as the "safety valve" of the society, which acts as a bridge connecting the government and citizens. As a convenient way to safeguard the rights and interests of society and citizens, letters and visits play a very important role in the imbalance in the transition and transition of the country. Social problems and contradictions are highlighted in the process of transformation, which makes the focus of petition work on maintaining social stability and unity. In the past 60 years, China's reform has been deepened, its economy has been transformed, and its interest structure has changed. It is very necessary to perfect and reform the petition system. Petition has the function of realizing citizen's political participation, expressing public opinion, dealing with contradiction, protecting rights and interests and maintaining stability. The change of an institution is caused by many factors, such as economy, politics and internal requirements of a society. This paper analyzes the process of institutional change in Shenyang's petition department, taking North's theory of institutional change as the supporting framework, starting with the institutional change of Shenyang's petition system as the object of study, and synthetically using various methods and means. This paper probes deeply into the course of the institutional changes of the petition department in Shenyang, and probes into the difficult problems and difficulties in the institutional change of the petition department in Shenyang, and leads to the countermeasures to solve them. In order to further improve the trend of institutional changes in the future to make a prediction. This paper is divided into five parts: the first part is the introduction, the main content is to discuss the background and significance of the paper research, the research situation at home and abroad, research methods and innovative points. The second part mainly introduces the concept of institution, the connotation and research model of institutional change theory. The third part introduces the history of the institutional changes of the petition department in Shenyang and the difficulties and difficulties in the institutional change of the petition department in Shenyang. The fourth part discusses the causes of the problems in the process of the change of petition system in Shenyang. The fifth part puts forward the relevant countermeasures to solve the problems in the system change of Shenyang petition department. In order to maintain the steady development of the country and society, the establishment of the petition department plays a very important role in ensuring the people's life. However, as the society is in a period of continuous transformation, the work of letters and visits, as a part of the whole system, should keep pace with the pace of social progress. The rationalization of the design of the petition system plays an irreplaceable role in the development of society. The current petition system in Shenyang should learn more from the experience and advantages of similar letters and visits systems in foreign countries and combine the current social situation of our country to improve the work mechanism of letters and visits in an all-round way so as to make the work of letters and visits serve the people's happy life better.
