【摘要】： 犯罪是一種正常的社會現(xiàn)象。隨著人類社會的不斷進步,尤其是現(xiàn)代化科學(xué)技術(shù)突飛猛進的發(fā)展,犯罪無論在數(shù)量上、規(guī)模上,還是在犯罪方法、對社會的危害程度上都發(fā)生了很大變化,對人類社會構(gòu)成的威脅越發(fā)變得嚴(yán)重。廣大學(xué)者和法律工作者也在不斷對犯罪預(yù)防的研究進行深化,運用刑罰手段預(yù)防犯罪,不僅是因為犯罪與刑罰構(gòu)成了刑事法律的基本內(nèi)容,而且是因為在任何有犯罪現(xiàn)象的社會形態(tài)中,刑罰都是犯罪預(yù)防的基本手段。這種手段運用的好與壞,對于減少社會上的犯罪現(xiàn)象具有明顯的、直接的影響。犯罪預(yù)防包括一般預(yù)防和特殊預(yù)防。一般預(yù)防,是指防止社會成員實施犯罪行為;特殊預(yù)防,是指預(yù)防特定的犯罪分子重新犯罪。法治是維系社會和諧的重要手段,社會主義和諧社會的特征體現(xiàn)著法治,公平正義是民主法治的必然結(jié)果。然而,法治社會發(fā)展到今天,隨著重新犯罪率的不斷升高,以及從諸多刑釋人員惡性案件頻發(fā)的現(xiàn)象看,懲罰作為一種預(yù)防犯罪的手段,其作用日趨弱化。監(jiān)獄內(nèi)的監(jiān)管改造形勢隨著社會的發(fā)展日趨復(fù)雜,國家雖然投入大量的人力物力,但是事實證明,目前的刑罰執(zhí)行效力卻是在下降,特殊預(yù)防的目的難以有效的實現(xiàn)。本人擬結(jié)合現(xiàn)階段監(jiān)獄管理中凸現(xiàn)的問題,從特殊預(yù)防的基本理論入手,重點結(jié)合現(xiàn)階段刑釋人員犯罪的特點和成因,以及制約實現(xiàn)預(yù)防犯罪的諸多因素,來淺談特殊預(yù)防的困境及現(xiàn)實構(gòu)想,并對現(xiàn)階段我國監(jiān)獄怎樣科學(xué)、準(zhǔn)確懲罰罪犯作一些理性思考。
[Abstract]:Crime is a normal social phenomenon. With the continuous progress of human society, especially the rapid development of modern science and technology, crime in terms of quantity, scale, or crime methods, Great changes have taken place in the degree of harm to society, and the threat to human society has become more and more serious. The vast number of scholars and legal workers are also continuously deepening the study of crime prevention and using penal means to prevent crime. Not only because crime and punishment constitute the basic content of criminal law, but also because in any society with criminal phenomenon, punishment is the basic means of crime prevention. Crime prevention includes general prevention and special prevention. General prevention means preventing members of society from committing criminal acts; special prevention, The rule of law is an important means to maintain social harmony, the characteristics of socialist harmonious society embodies the rule of law, fairness and justice is the inevitable result of democracy and rule of law. With the rising rate of recidivism and the frequent occurrence of vicious cases among released prisoners, the role of punishment as a means of crime prevention is weakening day by day, and the situation of prison supervision and reform is becoming more and more complicated with the development of society. Although the state has invested a lot of manpower and material resources, facts have proved that the effectiveness of the present penalty execution is declining, and the purpose of special prevention is difficult to be effectively realized. I intend to combine the problems highlighted in the present prison administration. Starting with the basic theory of special prevention, combining with the characteristics and causes of crime committed by released criminal personnel at the present stage, as well as the many factors restricting the realization of crime prevention, this paper briefly discusses the predicament and realistic conception of special prevention. And make some rational thinking about how to punish criminals scientifically and accurately.
