論韓國(guó)雇傭許可制下中韓勞務(wù)合作爭(zhēng)議的預(yù)防與解決

【摘要】:中韓兩國(guó)地緣相近,文緣相通。隨著經(jīng)濟(jì)全球化的浪潮及韓國(guó)經(jīng)濟(jì)的高速發(fā)展,自從上個(gè)世紀(jì)九十年代以來(lái),大量中國(guó)勞動(dòng)力涌入了韓國(guó)勞務(wù)市場(chǎng)。韓國(guó)的外國(guó)勞動(dòng)力引入制度度過(guò)了從產(chǎn)業(yè)研修制向雇傭許可制的演變。在雇傭許可制中韓勞務(wù)合作中,從運(yùn)行到事后管理都由政府直接負(fù)責(zé),勞務(wù)人員直接與韓國(guó)雇主簽訂標(biāo)準(zhǔn)勞務(wù)合同,形成雇傭合同關(guān)系。兩國(guó)政府指定的公共機(jī)構(gòu)為勞務(wù)人員提供幫助與服務(wù),不與勞務(wù)人員簽訂任何合同。由此,中韓雇傭制下的法律關(guān)系得以簡(jiǎn)化明確,勞動(dòng)者身份得到承認(rèn)。并且,由公共機(jī)構(gòu)運(yùn)營(yíng)管理,勞務(wù)派遣過(guò)程更為公正透明,勞務(wù)人員權(quán)益得到進(jìn)一步保障。然而,雇傭許可制并非解決外籍勞工問(wèn)題的完美方案,其自身的缺陷及不足加上外界種種因素的影響,導(dǎo)致了中韓勞務(wù)合作進(jìn)程中爭(zhēng)議的出現(xiàn),既包括勞務(wù)人員與韓國(guó)雇主之間圍繞勞動(dòng)報(bào)酬、安全生產(chǎn)、休息休假等發(fā)生的勞務(wù)爭(zhēng)議,也包括派遣過(guò)程中勞務(wù)人員與公共機(jī)構(gòu)之間因等待時(shí)間長(zhǎng),派遣率低及亂收費(fèi)引發(fā)的矛盾與問(wèn)題。形成問(wèn)題的原因多樣:韓國(guó)雇傭許可制本身存在的缺陷;雇主惡意侵害勞務(wù)人員權(quán)益;法律法規(guī)的不健全;我國(guó)政府機(jī)構(gòu)設(shè)置的不合理,工作理念的偏差,效率的低下;對(duì)韓勞務(wù)人員素質(zhì)較低等。針對(duì)雇傭制下中韓勞務(wù)合作中的問(wèn)題,文章提出了預(yù)防的建議:第一,改革管理機(jī)制,提高派出效率,擴(kuò)大合作規(guī)模;第二,細(xì)化國(guó)內(nèi)制度建設(shè),加強(qiáng)雙邊溝通;第三,鞏固政府服務(wù),保護(hù)勞務(wù)人員權(quán)益;第四,強(qiáng)化勞務(wù)人員出國(guó)前培訓(xùn)。針對(duì)中韓雇傭制下的勞動(dòng)爭(zhēng)議,文章在分析現(xiàn)行韓國(guó)法下的爭(zhēng)議解決方式的基礎(chǔ)上,對(duì)北美自由貿(mào)易協(xié)定下勞工爭(zhēng)端解決機(jī)制亦進(jìn)行了整理分析,并加以借鑒,得出對(duì)于中韓雇傭制下勞工爭(zhēng)端的解決,應(yīng)以協(xié)商調(diào)解為主,其相對(duì)于仲裁訴訟具有成本低、效率高的優(yōu)勢(shì)。文章的最后,對(duì)中韓雇傭制下勞務(wù)爭(zhēng)議的處理提出了建議。首先,對(duì)外勞務(wù)人員應(yīng)通過(guò)正當(dāng)途徑解決與雇主間的爭(zhēng)議,避免過(guò)激行為;其次,政府應(yīng)加快完善協(xié)商機(jī)制,充分重視協(xié)商、調(diào)解的爭(zhēng)議解決方式;最后,應(yīng)謹(jǐn)慎選擇仲裁、訴訟方式解決爭(zhēng)議,并在爭(zhēng)議解決的法律程序中強(qiáng)化雇主的舉證責(zé)任。此課題的研究,讓我們意識(shí)到,對(duì)中韓勞務(wù)合作方式的探索不應(yīng)止步,雇傭許可制下的中韓勞務(wù)合作仍面臨挑戰(zhàn)。如何更好地預(yù)防及解決爭(zhēng)議,使得中韓勞務(wù)合作能夠更加平順的展開(kāi)并步入常態(tài)化,值得進(jìn)一步研究與思考。這將對(duì)中韓勞務(wù)合作乃至中國(guó)與其他所有國(guó)家開(kāi)展勞務(wù)合作都具有積極意義。
[Abstract]:China and South Korea are geographically close, the edge connected. With the rapid development of economic globalization and the South Korean economy, since the last century since 90s, a large number of Chinese labor into the Korean labor market. South Korea's foreign labor into the system had evolved from industrial training system to the employment permit system. In China and South Korea cooperation in labor employment permit system, from operation to post management by the government is directly responsible for personnel, labor standards directly sign labor contract with the employer in South Korea, the formation of the employment contract. Two public institutions designated by the government to provide assistance and services for migrant workers do not sign any contracts with the laborers. Thus, the legal relations between China and South Korea employment system to simplify the clear, workers identity recognized. And, by the operation and management of public institutions, the labor dispatch process more fair and transparent, labor rights and interests further Security. However, the perfect scheme of employment permit system is not to solve the problem of foreign workers, affect their own shortcomings and deficiencies and external factors, led to the emergence of China and South Korea cooperation in the process of labor dispute, both on the labor remuneration, labor service personnel and Korean employers safety production, rest and vacations when labor dispute also, including labor dispatch process and public institutions for waiting for a long time, sending rate and charges caused by the contradictions and problems. The labor employment system in the cooperation between China and Korea, article puts forward some preventive suggestions: No. First, the reform of management mechanism, improve the dispatch efficiency, expand the scale of cooperation; second, the construction of domestic refining system, strengthen bilateral communication; third, strengthen government services, protect labor rights and interests; fourth, strengthen personnel training before going abroad. In China and South Korea employment system of labor dispute, based on the analysis of the current South Korean law under the dispute resolution on the basis, the mechanism of the North American Free Trade Agreement under the labor dispute settlement is also analyzed, and reference, obtain employment system of labor dispute in China and South Korea, should be based on the negotiation and mediation, the arbitration procedure has the advantages of low cost, high efficiency advantages. Finally, put forward suggestions to deal with the China and South Korea employment under labor disputes.
