警察權運行的規(guī)制探析

【摘要】：警察權作為國家實現(xiàn)治理目的而實施的一項特殊權力,其配置和施行狀況體現(xiàn)了社會的法治化程度。當前,警察權在運行中還存在如立法條文模糊、執(zhí)法權力擴張沖動、執(zhí)法者素質有待提高等問題。本文以分析警察權特征為切入點,從司法權和行政權角度探討警察權的權力屬性,通過有效規(guī)制警察權的運行,從而實現(xiàn)構建法治社會、保障人權的根本目的。
[Abstract]:Police power, as a special power implemented by the state to achieve the goal of governance, reflects the degree of the rule of law in the society. At present, there are still some problems in the operation of police power, such as the ambiguity of legislative provisions, the impulse of the expansion of law enforcement power and the need to improve the quality of law enforcers. Based on the analysis of the characteristics of police power, this paper discusses the power attributes of police power from the angle of judicial power and administrative power, and realizes the fundamental purpose of constructing a society ruled by law and safeguarding human rights by effectively regulating the operation of police power.
