【摘要】：中國(guó)農(nóng)村通過(guò)選擇武力的方式來(lái)解決民間糾紛問(wèn)題,是中國(guó)鄉(xiāng)土社會(huì)流傳已久的陋習(xí)。舊中國(guó)鄉(xiāng)土社會(huì)村民解決村際糾紛的方式會(huì)不約而同地選擇民間調(diào)解的武力手段,從而建立了武力規(guī)制下的村落秩序,并形成了一種武力陋習(xí)。武力陋習(xí)形成的根源是政府的腐敗、不作為導(dǎo)致的司法離場(chǎng),以及村民對(duì)"江湖好漢"的推崇、行動(dòng)的算計(jì)和話語(yǔ)權(quán)的爭(zhēng)奪。在當(dāng)今的鄉(xiāng)土中國(guó),這種武力陋習(xí)死灰復(fù)燃,以非常迅猛的速度在鄉(xiāng)村蔓延并與司法共生,擾亂了社會(huì)秩序,危害了公共安全。要消解這種武力陋習(xí),必須重新審視我們政府在農(nóng)村治理上的粗暴行為,以及進(jìn)一步規(guī)范民間體育社團(tuán),合理引導(dǎo)民間體育社團(tuán)的良性競(jìng)爭(zhēng),并通過(guò)法治和村民自治的有效融合,滿足農(nóng)民的公正性訴求。
[Abstract]:China's rural areas through the choice of force to resolve civil disputes, Chinese rural society has been circulating for a long time bad habits. The villagers in the rural society of old China chose the same means of folk mediation to solve the disputes between villages, thus establishing the order of villages under the rule of force and forming a bad habit of force. The root of the bad habit of force is the corruption of the government, the judicial departure caused by inaction, the praise of the villager to the "good man", the calculation of action and the struggle for the right to speak. In today's rural China, this habit of force is revived, spreading in the countryside at a very rapid speed and symbiosis with justice, disrupting social order and endangering public safety. In order to eliminate this bad habit of force, we must re-examine the violent behavior of our government in rural governance, further standardize the non-governmental sports associations, and rationally guide the healthy competition of the non-governmental sports associations. And through the effective integration of the rule of law and villager autonomy, to meet the fair demands of farmers.
