【摘要】： 贖刑是我國古代法律制度中的一項重要刑罰,它是規(guī)定犯人交納一定數(shù)量的“財”,以代替或抵銷其罪行的一種法律手段。秦朝的贖刑范圍較為廣泛,從耐刑、遷刑直到死刑都可以贖,但這些贖刑并不是對所有人都適用,贖鬼薪鋈足、贖宮和贖死都只適用于特權(quán)階層;在適用罪名上,也只適用于官吏的失職罪和瀆職罪、盜竊未遂罪、破壞官私財物罪等對社會危害程度不大的罪行;取贖的方式除了貲贖和役贖外,也兼及替贖、爵贖等其他方式。在秦朝贖刑的基礎(chǔ)上,漢代的贖刑無論是在使用范圍、適用對象、適用罪名、取贖方式還是在適用原則上都有了進(jìn)一步發(fā)展和完善,體現(xiàn)出了法律制度的繼承性和發(fā)展性。秦漢贖刑作為一種產(chǎn)生于封建社會的法律,階級性和剝削性是其共同的本質(zhì)特性,其施行具有一定的消極作用和影響。贖刑之所以在秦漢時期得到廣泛推行,其原因有三:1、政治上,統(tǒng)治階級緩和社會矛盾,維護(hù)其統(tǒng)治特權(quán)的需要。2、經(jīng)濟上,統(tǒng)治階級維護(hù)其經(jīng)濟統(tǒng)治、土地私有制的確立和經(jīng)濟發(fā)展的結(jié)果。3、傳統(tǒng)法律思想及文化的影響。相應(yīng)的,贖刑在秦漢時期的施行,又在政治、經(jīng)濟、軍事上保障了統(tǒng)治階級的統(tǒng)治,并在一定程度上惠及了百姓;就法律本身而言,秦漢贖刑又對當(dāng)時的刑罰體系產(chǎn)生了重要影響。
[Abstract]:Foreclosure is an important punishment in the ancient legal system of our country. It is a kind of legal means that stipulates the prisoners to pay a certain amount of "money" to replace or offset their crimes. Commutation until the death penalty can be redeemed, but these foreclosure does not apply to all, the foreclosure ghost salary is weak, the foreclosure palace and the foreclosure only applies to the privileged class; In the application of the crime, it only applies to the crime of dereliction of duty and dereliction of duty of officials, the crime of attempted theft, the crime of destroying official and private property, and other crimes which do little harm to the society. On the basis of the redemption of Qin Dynasty, the foreclosure in Han Dynasty is applicable to the scope of use, the applicable object, and the crime. The method of foreclosure has been further developed and perfected in the principle of application, which reflects the inheritance and development of the legal system. As a kind of law produced in the feudal society, the foreclosure in the Qin and Han dynasties is a kind of law. The nature of class and exploitation is its common essential characteristic, its implementation has certain negative effect and influence. The reason why foreclosure was widely carried out in the Qin and Han dynasties period is three: one, politically. The ruling class alleviates the social contradiction, maintains its rule privilege needs. 2. Economically, the ruling class maintains its economic rule, the establishment of private ownership of land and the result of economic development. 3. The influence of traditional legal thought and culture. Accordingly, the punishment of foreclosure carried out in the Qin and Han dynasties, and guaranteed the ruling class's rule in politics, economy and military affairs, and benefited the common people to a certain extent; As far as the law itself is concerned, the redeeming punishment in Qin and Han dynasties had an important influence on the penalty system at that time.
