公私產(chǎn)權(quán)制視野下的西漢鹽鐵專賣之爭

【摘要】：鹽鐵會(huì)議上的爭論深刻昭示了西漢王朝在“抑兼并”、實(shí)行鹽鐵專賣政策上的兩難境地:為尋求實(shí)施鹽鐵專賣的合法理由與道義支柱,政府面臨重新定位商業(yè)功能、地位的困境;因?yàn)椤白暨呝M(fèi)”、“緩民急”或“抑兼并”、“摧豪強(qiáng)”反映的是“公心”與“私心”的根本差別,政府又面臨確立專賣目的為“公”而非“私”的艱難局面;由于專賣過程中存在執(zhí)行官吏以權(quán)謀私的事實(shí),政府又陷于政策實(shí)行方式的兩難抉擇。從公、私產(chǎn)權(quán)角度檢視可以發(fā)現(xiàn),由空疏、含混的“公”“私”觀念而致界限模糊的公、私產(chǎn)權(quán)制度,乃是造成政府兩難困境的深層原因:它一方面無法確認(rèn)百姓的財(cái)產(chǎn)權(quán)利,保證百姓免受權(quán)貴的超經(jīng)濟(jì)壓榨;另一方面也給豪富權(quán)貴“假公濟(jì)私”、欺上壓下的行為以可乘之機(jī),帶來致使政府窮于應(yīng)付的兼并浪潮。
[Abstract]:The debate on the salt and iron conference revealed the dilemma of the Western Han Dynasty in "restraining merger" and carrying out the policy of salt and iron monopoly. In order to seek the legal reasons and moral pillars for the implementation of the salt and iron monopoly, the government is faced with the dilemma of repositioning the commercial function and the status of the Han Dynasty. The fundamental difference between "public heart" and "private heart" is reflected in the government. The government is faced with the difficult situation of establishing monopoly purpose for "public" rather than "private". Due to the fact that the executive officials seek power and privacy in the process of monopoly, the government is in a dilemma in the way of policy implementation. The public and private property and private property system are the deep reasons for the dilemma of the government. On the one hand, it can not confirm the property rights of the people and guarantee the people from the super economic squeeze. On the other hand, it also gives the rich and rich power to the "false public interest" and the act of bullying the press and bringing the cause. The government is poor to cope with a wave of mergers.
