【摘要】：環(huán)境權(quán)的規(guī)范效力包括可訴性效力和具體化效力�？稍V性效力指環(huán)境權(quán)直接作為審判依據(jù),具體化效力指借由立法間接影響審判。國外環(huán)境權(quán)訴訟中,結(jié)合憲法環(huán)境權(quán)規(guī)范和立法的具體條款作出裁判的案例同時(shí)體現(xiàn)可訴性效力和具體化效力;僅以憲法環(huán)境權(quán)規(guī)范為依據(jù)的案例,只運(yùn)用可訴性效力,是為環(huán)境權(quán)的自我執(zhí)行。環(huán)境權(quán)的自我執(zhí)行違背了形式理性優(yōu)先于實(shí)質(zhì)理性的原則和權(quán)力分立原則,僅在憲法司法化的國家處于環(huán)境立法體系尚未建立的階段有必要性。憲法環(huán)境權(quán)規(guī)范沒有規(guī)定法定效果,屬于原則范疇,其適用方式是和其他原則進(jìn)行衡量,經(jīng)由具體化為立法中的規(guī)則發(fā)揮作用。審理案件時(shí),法院應(yīng)優(yōu)先適用立法(具體化效力),在立法存在歧義或者沖突時(shí),法院可以借助對憲法環(huán)境權(quán)的解釋厘清立法的模糊之處(可訴性效力)。我國目前環(huán)境立法比較系統(tǒng),很大程度上消解了環(huán)境權(quán)訴訟的必要性;憲法尚未司法化更是徹底否定了環(huán)境權(quán)訴訟的可行性。不過,環(huán)境權(quán)入憲仍具有積極意義。
[Abstract]:The normative effect of environmental right includes actionable effect and concrete effect.The actionable effect refers to the environmental right as the direct basis of trial, and the concrete effect to indirectly influence the trial by legislation.In the foreign environmental right litigation, the cases that judge the constitution environmental right norms and the specific provisions of the legislation simultaneously reflect the actionable effect and the concrete effect; only the cases based on the constitutional environmental right norms only use the actionable effect.It is the self-enforcement of environmental rights.The self-enforcement of environmental rights violates the principle that formal rationality takes precedence over substantive rationality and the principle of separation of powers. It is necessary only in countries where the constitution is judicialized that the environmental legislation system has not yet been established.The norms of constitutional environmental rights do not stipulate the legal effect, they belong to the category of principles, their application is measured with other principles, and they play a role by concretely translating them into the rules in the legislation.When hearing a case, the court should give priority to the application of the legislation. When there is ambiguity or conflict in the legislation, the court can clarify the ambiguity of the legislation with the help of the interpretation of the constitutional environmental right.At present, the system of environmental legislation in our country has largely eliminated the necessity of environmental right litigation, and the fact that the constitution has not yet been judicialized completely negates the feasibility of environmental right litigation.However, environmental rights into the Constitution still have a positive significance.
