【摘要】: 鑒定程序的啟動問題,是探討鑒定制度的開門磚。目前世界上兩大法系國家對鑒定啟動程序都有比較系統(tǒng)的研究,并且隨著二者訴訟模式的相互融合,鑒定啟動程序也體現(xiàn)出相互借鑒融合的趨勢。本文筆者對我國民事訴訟鑒定啟動程序進(jìn)行介紹,分析我國民事訴訟中鑒定啟動程序的特點以及存在的不足,在借鑒兩大法系國家鑒定啟動程序先進(jìn)經(jīng)驗的基礎(chǔ)上,分析我國法院享有鑒定啟動程序決定權(quán)的合理性,并從以下幾個方面提出對我國鑒定啟動程序的完善意見:明確法官審查當(dāng)事人鑒定申請的法定標(biāo)準(zhǔn),對法律問題以及某些事實問題的鑒定申請應(yīng)當(dāng)予以排除,以通知書的方式告知當(dāng)事人是否同意其鑒定申請的理由,并對當(dāng)事人申請救濟(jì)的權(quán)利予以保障,如賦予當(dāng)事人申請復(fù)議的權(quán)利;對鑒定市場進(jìn)行規(guī)制,設(shè)立行業(yè)協(xié)會,明確收費(fèi)標(biāo)準(zhǔn),防止當(dāng)事人自主委托鑒定對鑒定人中立性的破壞;對當(dāng)事人申請鑒定的時間限制做彈性規(guī)定,對超過舉證期限而仍有必要進(jìn)行鑒定的情形,由法官根據(jù)是否符合公正審理的旨意據(jù)情決定;完善當(dāng)事人對鑒定人的選任程序,細(xì)化落實當(dāng)事人申請鑒定人回避的權(quán)利;對《證據(jù)規(guī)定》第二十八條規(guī)定的當(dāng)事人重新申請鑒定的條件應(yīng)當(dāng)放寬,使雙方當(dāng)事人享有平等的鑒定申請權(quán);明確鑒定材料提交過程中的“透明化”操作,即鑒定材料遞交程序必須公開、合法,當(dāng)事人對鑒定材料遞交過程有參與質(zhì)證和監(jiān)督的權(quán)利等等。通過上述建議,以期使我國民事訴訟中的鑒定制度發(fā)揮其更好的科學(xué)指導(dǎo)作用,使其成為當(dāng)事人維護(hù)自己合法權(quán)益以及法院維護(hù)公平正義的有力武器。
[Abstract]:The question of the initiation of the appraisal procedure is to discuss the open door brick of the appraisal system. At present, the countries of the two major legal systems in the world have comparatively systematic research on the identification initiation procedure, and with the mutual fusion of the two modes of litigation, The author introduces the procedure of identification and initiation of civil litigation in China, and analyzes the characteristics and shortcomings of the procedure of initiation of identification in civil litigation in China. On the basis of drawing lessons from the advanced experience of the identification and initiation procedure in the countries of two legal systems, this paper analyzes the reasonableness of the decision power of the court in our country. And from the following aspects, the author puts forward some suggestions on how to perfect the procedure for the initiation of appraisal in China: it is clear that the legal standard of the judge to examine the application for the identification of the parties concerned, and the application for the identification of the legal and some factual issues should be excluded. To inform the parties by notice whether they agree with the reasons for their application for appraisal, and to protect the right of the parties to apply for relief, such as giving the parties the right to apply for reconsideration, regulating the appraisal market, and setting up trade associations, To clarify the charging standard, to prevent the parties from independently entrusting the appraisal to destroy the neutral character of the authenticator, to make flexible provisions on the time limit for the parties to apply for the appraisal, and to make flexible provisions on the cases where it is still necessary to carry out the appraisal after the time limit of proof is exceeded, According to whether the judge is in accordance with the will of a fair trial according to the situation; perfect the procedure of selecting and appointing the expert, and implement the right of the party to apply for the expert's recusal; The conditions for the parties to re-apply for appraisal as stipulated in Article 28th shall be relaxed so that both parties shall enjoy equal rights to apply for appraisal, and the "transparency" operation in the process of submitting appraisal materials shall be clearly defined. That is, the procedure for submitting identification materials must be open and legal, and the parties have the right to participate in cross-examination and supervision of the process of submitting identification materials. It is hoped that the appraisal system in civil litigation in our country will play a better role in scientific guidance and become a powerful weapon for the parties concerned to safeguard their legitimate rights and interests and for the courts to safeguard fairness and justice.
