【摘要】： 恐怖主義已經(jīng)成為了一種國際現(xiàn)象,可以說它的危害已經(jīng)超過了跨國犯罪、毒品走私的危害。我國反對一切形式的恐怖主義,不論它是本國的還是外國的。隨著國際打擊恐怖主義的深入我國也積極參與并大力支持,已經(jīng)取得了顯著的成效。同時國際各國在打擊恐怖主義的道路上取得了一些寶貴經(jīng)驗。可以說各國在打擊恐怖主義的問題上已經(jīng)達(dá)成了共識,這是積極而難能可貴的。但是不論是在立法上還是在國家間合作上,打擊國際恐怖主義犯罪都有一定的困難,怎樣把這些困難消除,需要我們付出更多的努力。同時就我國的反恐立法舉措而言,已經(jīng)滯后于國際恐怖主義的發(fā)展。 本文從國際恐怖主義犯罪的概念出發(fā),深入探討其特征和構(gòu)成,指出其危害。簡要列舉現(xiàn)階段國際社會一些主要的恐怖集團(tuán)和主要犯罪類型并簡要分析。簡述其發(fā)展過程并分析其出現(xiàn)的原因和實質(zhì)。其次列舉和分析現(xiàn)階段國際社會打擊恐怖主義犯罪的立法現(xiàn)狀,最終分析和探討我國立法包括刑事立法的相關(guān)內(nèi)容,并對我國立法完善提供一些建議。
[Abstract]:Terrorism has become an international phenomenon, which can be said to be more harmful than transnational crime and drug smuggling. My country opposes terrorism in all its forms, whether domestic or foreign. With the deepening of the international fight against terrorism, China has also actively participated in and strongly supported, has achieved remarkable results. At the same time, international countries have gained some valuable experience on the road of fighting terrorism. It can be said that countries have reached consensus on the issue of combating terrorism, which is positive and commendable. However, whether in legislation or in cooperation between countries, there are certain difficulties in combating international terrorism, how to eliminate these difficulties, we need to pay more efforts. At the same time, China's anti-terrorism legislation has lagged behind the development of international terrorism. Based on the concept of international terrorism, this paper probes into its characteristics and constitution, and points out its harm. This paper briefly lists some major terrorist groups and major types of crimes in the international community and analyzes them briefly. The development process is briefly described and the causes and essence of its appearance are analyzed. Secondly, this paper enumerates and analyzes the current legislative situation of the international community to combat terrorist crimes, and finally analyzes and discusses the relevant contents of our legislation, including criminal legislation, and provides some suggestions for the perfection of our legislation.
