【摘要】：利用網絡是全球化背景下恐怖主義的新特征和發(fā)展趨勢。網絡恐怖主義作為新的全球性犯罪問題,越來越多地在非傳統(tǒng)安全領域影響著國家的政治、經濟等諸多方面。作為全球網絡用戶排名第一及黑客入侵的最主要受害國和攻擊對象之一,中國的網絡信息安全形勢不容樂觀。因此,如何應對網絡恐怖主義產生的威脅,正逐漸成為一個國家尤其是國家安全機關必須應對的新課題。 本文從網絡恐怖主義犯罪的科學內涵入手,在與公安、安全等政法機關法制與技術偵察部門人員溝通的基礎上,甄選出部分已公開的網絡恐怖違法犯罪案件樣本,并結合自身實際工作體驗,深刻分析網絡恐怖主義犯罪產生的根源,研究歸納其表現(xiàn)形式及主要特征,提出要借鑒國際組織及先進國家的成功經驗,分析論證構建網絡反恐防范措施的創(chuàng)新思路,主張多手段、多領域從國家安全戰(zhàn)略高度,建立健全法律體系、強化完善國際合作、推動技術力量精湛化、加快技術管控等綜合防治的對策。文章重點從法律層面,特別是程序法與實體法等維度,充分整合利用現(xiàn)存法律資源,力求全面發(fā)揮法律在網絡反恐方面的成效。既注重法律的運行,又最大限度地凸顯其前瞻性,做到嚴肅對待、嚴格防控、有效制止,將網絡恐怖主義的危害遏制到較低范圍。
[Abstract]:Using network is the new characteristic and development trend of terrorism under the background of globalization. As a new global crime problem, cyberterrorism is more and more influencing the politics, economy and so on in the non-traditional security field. As the number one of the global network users and one of the most important victims and targets of hacking, the situation of network information security in China is not optimistic. Therefore, how to deal with the threat of cyberterrorism is becoming a new issue that a country, especially the national security organs, must deal with. Starting from the scientific connotation of the crime of cyberterrorism, and on the basis of communicating with the personnel of the legal and technical investigation departments of the political and legal organs, such as public security, this paper selects some open samples of the cases of illegal and criminal network terrorism. Combined with its own practical work experience, the author deeply analyzes the root causes of the crime of network terrorism, studies and summarizes its manifestation and main characteristics, and puts forward that the successful experiences of international organizations and advanced countries should be used for reference. This paper analyzes and demonstrates the innovative ideas of constructing network anti-terrorism prevention measures, advocates multi-means and multi-fields from the height of national security strategy, establishes and perfects the legal system, strengthens and perfects international cooperation, and promotes the consummation of technical force. Speed up technical control and other comprehensive prevention and control countermeasures. This paper focuses on the aspects of law, especially procedural law and substantive law, and makes full use of existing legal resources, and tries to give full play to the effectiveness of law in network counter-terrorism. It not only pays attention to the operation of the law, but also highlights its foresight to the maximum extent, so as to take it seriously, strictly prevent and control it, and effectively stop it, so as to contain the harm of network terrorism to a lower range.
