【摘要】：在不同的法律制度、機制和文化環(huán)境下,不同性質(zhì)的先前經(jīng)驗可能會以不同的方式作用于司法裁判。具備體制內(nèi)和體制外工作經(jīng)驗的法官具備不同的知識優(yōu)勢,進而通過不同的方式促進司法裁判。其作用機制因法官知識結(jié)構(gòu)的差異而不同。在法治化程度較高的地區(qū),體制外工作經(jīng)驗對司法裁判的促進作用更強,同時借助動用體制內(nèi)的社會關(guān)系能提升具備體制外經(jīng)驗法官的司法裁判能力。理應(yīng)化解甚至打破“行政”和“司法”并存甚至相互競爭的格局,培育法治文化和法律意識。啟發(fā)立志于從事法官職業(yè)或正進行法官職業(yè)的人員理性的積累有助于未來司法裁判公正性的經(jīng)驗。
[Abstract]:In different legal systems, mechanisms and cultural settings, prior experience of a different nature may play a different role in the administration of justice. Judges with working experience both within and outside the system have different intellectual advantages. Then through different ways to promote the administration of justice. Its mechanism is different because of the different knowledge structure of judges. In areas with higher degree of rule of law, the work experience outside the system has a stronger role to promote the judicial decision. At the same time, with the help of the social relations within the system, we can enhance the judicial judgment ability of judges with experience outside the system. We should resolve or even break the pattern of "administration" and "judicature" coexist and even compete with each other. To cultivate the culture of rule of law and the consciousness of law, to inspire the rational accumulation of personnel who are determined to engage in or are engaged in the profession of judges will be helpful to the future experience of justice in the administration of justice.
