【摘要】：法官自由裁量權(quán)是指法官將法律規(guī)范和具體的法律事實(shí)相結(jié)合的過(guò)程中能夠推出兩個(gè)以上具有合法性的結(jié)論時(shí)行使的選擇權(quán)。在實(shí)踐中存在法官自由裁量權(quán)是順應(yīng)歷史潮流的現(xiàn)象,同時(shí)自由裁量權(quán)也不能消除,只能在司法實(shí)踐當(dāng)中進(jìn)一步的規(guī)范。但是,法官自由裁量權(quán)畢竟有其積極的一面和消極的一面,我們所能做的就是為其正當(dāng)?shù)男惺箘?chuàng)造空間,并使其通過(guò)程序的行使和說(shuō)明理由使其正當(dāng)化；對(duì)其過(guò)大的裁量空間予以縮減,以防止其濫用和擴(kuò)張法。同時(shí)在實(shí)踐當(dāng)中法官的個(gè)人法學(xué)素養(yǎng)、審判經(jīng)驗(yàn)等不相同,導(dǎo)致“同案不同判”的現(xiàn)象時(shí)有發(fā)生,因此,《人民法院量刑指導(dǎo)意見(jiàn)(試行)》的出臺(tái)在一定程度上對(duì)法官自由裁量權(quán)提出了一定的規(guī)范,指導(dǎo)意見(jiàn)也有其自身的發(fā)展趨勢(shì),在今后的實(shí)踐當(dāng)中,指導(dǎo)意見(jiàn)也會(huì)向著更加規(guī)范的方向發(fā)展,本文也將以《人民法院量刑指導(dǎo)意見(jiàn)(試行)》為視角,對(duì)法官自由裁量權(quán)提出一些規(guī)范的建議。 本文分為四部分,第一部分從法官自由裁量權(quán)的概念入手,介紹中外學(xué)者對(duì)自由裁量權(quán)的見(jiàn)解,并得出自己的結(jié)論,并且闡述法官自由裁量權(quán)的特點(diǎn)與范圍。這部分在整篇論文中起到了鋪墊和引導(dǎo)的作用。第二部分介紹了自由裁量權(quán)在刑事審判中的具體表現(xiàn),為下文規(guī)范自由裁量權(quán)分析做了準(zhǔn)備。第三部分介紹了自由裁量權(quán)的出臺(tái)的背景、價(jià)值、運(yùn)行狀況以及對(duì)其出臺(tái)的一些思考。第四部分結(jié)合《人民法院量刑指導(dǎo)意見(jiàn)(試行)》提出在立法及司法上對(duì)自由裁量權(quán)規(guī)范的意見(jiàn)。
[Abstract]:The discretion of a judge is the right of choice exercised by a judge in the process of combining legal norms with specific legal facts. In practice, the existence of a judge's discretion is in conformity with the existence of two or more legitimate conclusions. The phenomenon of responding to the trend of history. At the same time, discretion can not be eliminated, can only be further standardized in judicial practice. However, the discretion of judges after all has its positive side and negative side. All we can do is create space for its proper exercise and justify it through the exercise and justification of procedures; At the same time, in practice, judges' personal legal literacy, trial experience and other differences, resulting in "different decisions in the same case" phenomenon occurred from time to time. Therefore, the introduction of the sentencing guidance of the people's Court (trial) to a certain extent put forward certain norms on the discretion of judges, the guidance also has its own development trend, in the future practice. The guidance will also develop towards a more standardized direction, this paper will also take the sentencing guidance of the people's Court (trial) as the angle of view, and put forward some standard suggestions to the judge's discretion. This paper is divided into four parts. The first part starts with the concept of the discretion of judges, introduces the opinions of Chinese and foreign scholars on discretion, and draws its own conclusions. And elaborated the judge discretion characteristic and the scope. This part has played the role of paving and guiding in the entire thesis. The second part has introduced the discretion in the criminal trial concrete performance. The third part introduces the background and value of discretion. Part 4th, combined with the sentencing guidance of the people's Court (trial), puts forward the opinions on the regulation of discretion in legislation and judicature.
