【摘要】：檢察一體化是世界三大法系國家均確立的一項(xiàng)檢察組織原則,是人們對檢察制度中有關(guān)上命下從的權(quán)力運(yùn)行方式的概括。我國是社會主義法系的主要代表國家,我國的檢察制度與大陸法系、英美法系國家存在不同程度的差異,我國的檢察一體化因而具有鮮明的中國特色。檢察權(quán)的定位是檢察一體化的理論基礎(chǔ)和邏輯前提,本文以比較法的視角,對我國檢察權(quán)的性質(zhì)進(jìn)行了界定,明確檢察權(quán)是法律監(jiān)督權(quán),同時對檢察一體化的意義進(jìn)行了闡述,并在此基礎(chǔ)上論述了中國特色檢察一體化的科學(xué)內(nèi)涵及其實(shí)現(xiàn)方式。
[Abstract]:The procuratorial integration is a principle of procuratorial organization established by the three legal system countries in the world. It is the summary of the operation mode of the procuratorial system about the power under the order of the superior. China is the main representative country of the socialist law system. The procuratorial system of our country is different from that of the civil law system and the Anglo-American law system to some extent. The position of procuratorial power is the theoretical basis and logical premise of procuratorial integration. This paper defines the nature of procuratorial power in China from the perspective of comparative law. It is clear that the procuratorial power is the power of legal supervision, at the same time, the significance of the procuratorial integration is expounded, and on this basis, the scientific connotation of the procuratorial integration with Chinese characteristics and the way to realize it are discussed.
