【摘要】：中華人民共和國成立以來，特別是改革開放30余年來，法治觀念日益深入人心，法治理論不斷豐富發(fā)展，我國的法治建設(shè)取得了可喜成就。律師作為社會主義法律工作者，在立法、執(zhí)法、司法等多個領(lǐng)域，為我國法治建設(shè)做出了卓越貢獻(xiàn)。 論文以“律師在我國法治建設(shè)中的作用”為題，以北京市100個律師樣本進(jìn)行實(shí)證分析，旨在加強(qiáng)對律師在我國法治建設(shè)中作用的研究，深化相關(guān)理論認(rèn)識，保證律師法治建設(shè)作用的充分發(fā)揮，推動我國法治建設(shè)的全面發(fā)展。 論文主要分四個部分。第一部分，回憶了新中國律師制度的發(fā)展和我國法治建設(shè)的歷史。第二部分，分析了律師在我國法治建設(shè)中作用的范圍，即何為律師在我國法治建設(shè)中的作用。第三部分，以調(diào)研材料為基礎(chǔ)，詳細(xì)論述了律師在我國法治建設(shè)中作用的各種表現(xiàn)形式和特點(diǎn)。第四部分，結(jié)合調(diào)研材料，對律師在我國法治建設(shè)中面臨的困難和挑戰(zhàn)進(jìn)行了思考，并就保障律師在我國法治建設(shè)中作用的充分發(fā)揮提出了相應(yīng)建議。 論文可能的主要創(chuàng)新點(diǎn)：(1)從律師職業(yè)本身、立法領(lǐng)域、執(zhí)法領(lǐng)域、司法領(lǐng)域和其他領(lǐng)域多方面分析律師在我國法治建設(shè)中作用的表現(xiàn)形式，并根據(jù)調(diào)研材料進(jìn)行分析，歸納概括律師在各個領(lǐng)域作用的一般特點(diǎn)。 (2)通過問卷調(diào)研，將律師在立法領(lǐng)域、執(zhí)法領(lǐng)域、司法領(lǐng)域和其他領(lǐng)域的法治作用相關(guān)數(shù)據(jù)進(jìn)行了比較分析，得出律師在立法領(lǐng)域和執(zhí)法領(lǐng)域作用有限、有待發(fā)掘等結(jié)論。 (3)在實(shí)證分析的基礎(chǔ)上，從相關(guān)體制、社會文化觀念、律師自身等多個角度，闡述我國律師在促進(jìn)國家法治化過程中面臨的困難和挑戰(zhàn)，并提出相關(guān)建議。
[Abstract]:Since the founding of the people's Republic of China, especially in the more than 30 years since the reform and opening up, the concept of rule of law has become increasingly popular, the theory of the rule of law has been enriched and developed, and the construction of the rule of law in our country has made gratifying achievements. In legislation, law enforcement, judicature and other fields, has made outstanding contributions to the construction of the rule of law in China. This paper is entitled "the role of lawyers in the Construction of the Rule of Law in China", and takes 100 samples of lawyers in Beijing for empirical analysis, in order to strengthen the research on the role of lawyers in the construction of the rule of law in China, and deepen the relevant theoretical understanding. To ensure the full play of the role of lawyers in the construction of the rule of law and promote the overall development of the construction of the rule of law in China. The first part recalls the development of the lawyer system in New China and the history of the construction of the rule of law in China. The second part analyzes the scope of the role of the lawyer in the construction of the rule of law in China. That is, what is the role of lawyers in the construction of the rule of law in our country. The third part, based on the investigation materials, discusses in detail the various forms and characteristics of lawyers' role in the construction of the rule of law in our country. Part 4th, combined with the investigation materials, This paper discusses the difficulties and challenges faced by lawyers in the construction of the rule of law in our country, and puts forward corresponding suggestions to ensure the full play of the role of lawyers in the construction of the rule of law in our country. The main innovation of this paper is to analyze the expression forms of lawyers' role in the construction of the rule of law in our country from the aspects of lawyer profession itself, legislative field, law enforcement field, judicial field and other fields, and analyze it according to the research materials. Generalize and generalize the general characteristics of lawyers' role in various fields. (2) through questionnaire investigation, the author makes a comparative analysis of the relative data on the role of lawyers in the legislative field, the law enforcement field, the judicial field and other fields, and draws the conclusion that the role of the lawyer in the legislative field and the law enforcement field is limited and remains to be explored. On the basis of empirical analysis, this paper expounds the difficulties and challenges faced by Chinese lawyers in the process of promoting the rule of law in China from the perspectives of relevant systems, social and cultural concepts, and lawyers themselves, and puts forward some relevant suggestions.
