【摘要】：近現(xiàn)代陪審制度傳入我國至今,陪審員的參審多流于形式上的“名譽(yù)陪審”。在司法實(shí)踐中,陪審員的存在價值毫無發(fā)展,陪審制度形同虛設(shè),有的學(xué)者甚至建議廢除。然而,在理論上,陪審制度是我國訴訟制度乃至整個司法制度中的重要組成部分。完善人民陪審員制度是民主法治建設(shè)中的重要環(huán)節(jié),它對司法程序的正當(dāng)化能起到很大的推動作用。在實(shí)踐中,陪審制度可以一方面對公權(quán)力形成制約,遏制法官的恃權(quán)濫用;一方面對私權(quán)利有效保護(hù),保障公民的合法權(quán)益。另外還有助于增強(qiáng)司法審判的權(quán)威性,提高司法機(jī)關(guān)在社會大眾中的公信力。歷史上,沒有哪個制度從設(shè)立之初就是完美的,本文通過對比中美陪審制度及闡述制度變遷,探索制度完善之道,以期為現(xiàn)實(shí)問題的解決提供可行方案。 本文共分四部分,具體如下: 第一部分介紹美國陪審團(tuán)制度的主要內(nèi)容。首先對陪審團(tuán)制度的形成和發(fā)展,陪審員的遴選及陪審團(tuán)的運(yùn)作進(jìn)行概述。然后,從法律保障和權(quán)力制約兩方面談美國司法制度對陪審員的保障與制約。 第二部分重點(diǎn)介紹我國人民陪審員制度的主要內(nèi)容。首先概述我國人民陪審員制的歷史沿革和運(yùn)作發(fā)展,然后介紹人民陪審員的選任與人民陪審制的現(xiàn)狀,包括人民陪審員的適用范圍、所享有的權(quán)利義務(wù)及相關(guān)制度保障等。 第三部分集中對陪審團(tuán)制度與人民陪審員制度進(jìn)行比較。從宏觀和微觀上對比美國陪審團(tuán)制和我國的人民陪審員制,歸納總結(jié)出其各自優(yōu)劣所在。意在通過制度比較,發(fā)掘相同問題不同的處理機(jī)制與價值取向,進(jìn)而為完善我國人民陪審制度提供借鑒。 在此基礎(chǔ)上,第四部分總結(jié)結(jié)論并提出建議。即通過科學(xué)地認(rèn)識陪審制度并對完善我國的人民陪審制度提出見解。首先從重視陪審制的價值切入,再從培養(yǎng)人民陪審制存在的基礎(chǔ)、積極推動群眾廣泛參與、提升陪審員的訴訟地位、增加經(jīng)費(fèi)保障等方面加以論述。以期拋磚引玉引起各界對人民陪審制的重視,提出可行性方案,解決現(xiàn)實(shí)問題。
[Abstract]:The modern jury system was introduced into China since the jury trial is only a form of "honorary jury". In judicial practice, there is no development value of the jury, the jury system useless, some scholars even suggested abolishing. However, in theory, the jury system is an important part of China's litigation system the whole judicial system. Improving the people's jury system is an important link in the construction of democracy and the rule of law, it justifies the judicial process can play a significant role in promoting. In practice, the jury system can be a constraint on the formation of public power, curb the judge relies on the abuse of the right hand; the effective protection of the private right, safeguard the legitimate rights and interests of citizens. In addition to help strengthen judicial authority, improve the judicial credibility in the community. In history, no system is perfect from the beginning of the establishment By comparing the Chinese and American jury system and elaborating the institutional change, this paper explores the way to improve the system so as to provide a feasible solution for the solution of the practical problems.
This article is divided into four parts, which are as follows:
The first part introduces the main contents of the jury system in the United States. First, it summarizes the formation and development of jury system, the selection of jurors and the operation of jury. Then, it discusses the guarantee and restriction of juridical system from two aspects: legal protection and power restriction.
The second part focuses on the main content of the jury system in our country. Firstly, our people's jury system in history and business development, and then introduces the people's jury selection and the status of the people's jury system, covers a wide range of people's assessors, the rights and obligations and related security system.
The third part focuses on the comparison of the jury system and the people's jury system. From the macro and micro comparison of American jury system and Chinese people's jury system, it summarizes the advantages and disadvantages. Through comparison of system, mechanism and value orientation to explore the same different problems, so as to improve the people's jury system our country for reference.
On this basis, the fourth part summarizes the conclusions and suggestions are put forward. Through scientific understanding of the jury system and put forward opinions on perfecting the people's jury system in China. Firstly, from the emphasis on the value of the jury system from the foundation of the existence of culture into the people's jury system, and actively promote the extensive participation of the masses, to enhance the status of litigation of the jury. To discuss increasing funding. To arouse the attention of the people's jury system, put forward the feasible scheme to solve practical problems.
