【摘要】：本文旨在論述如何以法官職業(yè)意識養(yǎng)成機制作為深入推進法院文化建設(shè)體系與法官職業(yè)化的核心工作和中心內(nèi)容。 通過職業(yè)意識與法官職業(yè)意識的修辭學定義與內(nèi)涵演繹,對法官職業(yè)意識做出概念上的精確界定與內(nèi)容上的清晰展示,演證法官職業(yè)意識的養(yǎng)成過程與養(yǎng)成結(jié)構(gòu),進而確立法官職業(yè)意識養(yǎng)成機制的三個主要研究方向。 通過對法官職業(yè)意識養(yǎng)成機制的承載平臺——法院文化建設(shè)體系進行現(xiàn)狀分析,經(jīng)由其主體構(gòu)成、架構(gòu)層次和主題范疇三個層次來進行邏輯梳理,分析出這一載體未能有效發(fā)揮主體能動性的缺失。同時,經(jīng)過對司法機關(guān)所面臨的執(zhí)政黨、立法機關(guān)、行政機關(guān)及社會外部環(huán)境的制約分析,經(jīng)過對司法機關(guān)內(nèi)部職務(wù)設(shè)置行政化、審判管理官僚化成因的分析,深入挖掘法官職業(yè)意識養(yǎng)成機制的根本問題與運行障礙。 通過比較西方法官職業(yè)意識養(yǎng)成機制的發(fā)展軌跡,確立以司法核心價值觀教育、學識教育、法官職業(yè)榮譽與職業(yè)良心教育作為法官職業(yè)意識養(yǎng)成機制的核心內(nèi)涵,來培育法律信仰和職業(yè)道德,實現(xiàn)審判藝術(shù)化。在激勵和保障制度上,以憲法確認法院獨立行使司法權(quán),以各項激勵制度措施來完善對法官職業(yè)意識養(yǎng)成機制的保障與支持,并借鑒具體的個案來探索當前的先驗成果與發(fā)展趨勢。
[Abstract]:The purpose of this paper is to discuss how to develop the professional consciousness of judges as the core work and the central content of promoting the construction system of court culture and the professionalization of judges. Through the rhetorical definition and deduction of the professional consciousness of the judge and the professional consciousness of the judge, this paper makes a precise definition of the professional consciousness of the judge and a clear display of the content, and testifies to the formation process and structure of the professional consciousness of the judge. And then establish three main research directions of professional consciousness formation mechanism of judges. Through the analysis of the present situation of the construction system of court culture, which is the bearing platform of the professional consciousness formation mechanism of judges, this paper makes a logical analysis through its main body composition, structure level and subject category. At the same time, after analyzing the restriction of the ruling party, the legislature, the executive organ and the external environment of the society, the author points out that the carrier can not play the role of the main body effectively. Through the analysis of the causes of the establishment of the internal position of the judiciary and the bureaucracy of the trial management, the basic problems and operational obstacles of the formation mechanism of the judges' professional consciousness are deeply excavated. By comparing the development track of the professional consciousness formation mechanism of the western judges, the author establishes that the core connotation of the judges' professional consciousness cultivation mechanism is the judicial core values education, the learning education, the judges' professional honor and the professional conscience education. To cultivate legal belief and professional ethics, to realize the artistry of trial. In the system of encouragement and guarantee, the constitution confirms the independent exercise of judicial power by the court, and the measures of every incentive system are used to perfect the guarantee and support to the mechanism of fostering the professional consciousness of judges. And draw lessons from specific cases to explore the current transcendental results and development trends.
