【摘要】：一般認為,在民主國家,法律是由民意機關(guān)經(jīng)民主程序制定,法律是民意的一種體現(xiàn),司法部門作為適用法律的專職機關(guān)遵循法律、合乎民意地進行判決。按照這樣一種邏輯理解,民意與司法之間應(yīng)當(dāng)并行不悖,而不應(yīng)當(dāng)存在對立與沖突�？墒菍嶋H生活中所出現(xiàn)的案例卻表明民意與司法關(guān)系的真實狀態(tài)并非如此,民意與司法的緊張關(guān)系已經(jīng)在某些個案中突顯出來,兩者的對立和沖突使司法陷入兩難的困境,引發(fā)了在司法過程中如何對待民意之爭。 在這樣的背景下,本文通過對司法語境中民意的概念、形成及特征進行概述分析,在對民意與司法關(guān)系演變的社會條件及基礎(chǔ)理論進行闡釋的基礎(chǔ)上,對民意與司法的關(guān)系進行了評判。在回答了民意影響司法“能或不能”、“應(yīng)不應(yīng)當(dāng)”實然與應(yīng)然兩個不同層面的問題后,探索司法對待民意的合理路徑。借助立法程序使民意能夠通過合法化的途徑進入司法運作中來,讓民意在一個可以控制的范圍內(nèi)活動,通過司法對民意的理性識別和回應(yīng),實現(xiàn)民意與司法的良性互動。
[Abstract]:It is generally believed that in a democratic country, the law is formulated by the organs of public opinion through democratic procedures, and the law is a manifestation of public opinion. The judiciary, as the specialized organ that applies the law, follows the law. Adjudication in accordance with public opinion. According to such a logical understanding, public opinion and justice should go hand in hand, There should be no confrontation or conflict. However, the actual cases in real life show that the true state of the relationship between public opinion and justice is not the same, and the tension between public opinion and justice has been highlighted in some cases. The opposition and conflict between the two make the judicature in a dilemma, which leads to the dispute about how to deal with public opinion in the judicial process. In this context, this paper analyzes the concept, formation and characteristics of public opinion in the judicial context, on the basis of explaining the social conditions and basic theories of the evolution of the relationship between public opinion and justice. The relationship between public opinion and justice is judged. After answering the questions of whether public opinion affects justice "can or cannot", "should not" actually and ought to be, To explore a reasonable path for judicial treatment of public opinion. With the aid of legislative procedures, public opinion can enter the judicial operation through the way of legalization, so that public opinion can operate within a scope of control and rationally identify and respond to public opinion through the administration of justice. Realize the benign interaction between public opinion and judicature.
