【摘要】：2006年9月,最高人民法院正式發(fā)布了《人民法院新聞發(fā)布制度》,全國各高級人民法院設(shè)立新聞發(fā)言人,宣告以最高人民法院和高級人民法院為主體的兩級新聞發(fā)布制度正式建立。 本文以人民法院新聞發(fā)言人制度的完善為論述內(nèi)容。全文分為三個部分。 第一部分主要介紹了人民法院新聞發(fā)言人制度的概況、法理學(xué)根源和特點(diǎn)及要求,具有鮮明的特點(diǎn)和不同,其特點(diǎn)是:權(quán)威性、程序性、公正性和中立性及時效性。 第二部分通過對“李啟銘撞死河北大學(xué)學(xué)生案”這一典型案例的分析指出了人民法院新聞發(fā)言人制度的現(xiàn)狀和缺陷包括:新聞發(fā)布主體和發(fā)布渠道狹窄、對于禁止發(fā)布的信息規(guī)定過于含混、寬泛、新聞發(fā)言人制度偏重于宣傳,過分強(qiáng)調(diào)法院的不容懷疑、缺乏問責(zé)機(jī)制等。 第三部分著重探討了如何完善人民法院新聞發(fā)言人制度,分析了互聯(lián)網(wǎng)在人民法院新聞發(fā)言人制度中的運(yùn)用。提出完善人民法院新聞發(fā)言人制度的方法,從新聞發(fā)言人制度的機(jī)構(gòu)設(shè)置、完善新聞發(fā)言人制度的形式、補(bǔ)充最高人民法院新聞發(fā)言人制度設(shè)計(jì)、建立新聞發(fā)言人制度的問責(zé)機(jī)制等方面進(jìn)行論述,并且設(shè)計(jì)了新聞發(fā)言人制度的效果及評價機(jī)制。
[Abstract]:In September 2006, the Supreme people's Court officially issued the "system of Press release of the people's Court", and a press spokesman was set up by various higher people's courts throughout the country. The two-level press release system, with the Supreme people's Court and the higher people's Court as the main body, was formally established. This paper discusses the perfection of the press spokesman system of the people's court. The full text is divided into three parts. The first part mainly introduces the general situation of the press spokesman system of the people's court, the origin, characteristics and requirements of jurisprudence, which have distinct characteristics and differences, such as authority, procedure, impartiality, neutrality and timeliness. In the second part, through the analysis of the typical case of Li Qiming killing a student in Hebei University, the author points out the present situation and defects of the press spokesman system of the people's Court, including: the main body of press release and the narrow distribution channel. The rules on the prohibition of publication of information are too vague and broad, the press spokesman system is biased toward publicity, too much emphasis is placed on the irrefutable nature of the court, and there is no accountability mechanism. The third part focuses on how to perfect the press spokesman system of the people's court, analyzes the application of the Internet in the press spokesman system of the people's court, and puts forward the methods to perfect the press spokesman system of the people's court. From the aspects of setting up the press spokesman system, perfecting the form of the press spokesman system, supplementing the design of the press spokesman system of the Supreme people's Court, and establishing the accountability mechanism of the press spokesman system, etc. And has designed the news spokesman system the effect and the appraisal mechanism.
