【摘要】：上世紀(jì)八十年代,社會主義波蘭引入憲法裁判所制度。憲法裁判所作為憲法法院的前身,波蘭憲法法院迄今已走過三十余年的歷程。波蘭憲法法院通過自身的憲法實踐,在波蘭國家機構(gòu)及民眾之間樹立起權(quán)威地位,在波蘭民主政治建設(shè)過程中發(fā)揮著越來越重要的作用。本文分別從歷史源流、制度內(nèi)容以及運行特點等方面對波蘭憲法法院進行研究。第一章在介紹波蘭的憲政歷史的基礎(chǔ)上,闡述波蘭波蘭憲法法院制度植根于波蘭悠久的憲政傳統(tǒng)。憲法法院制度非憑空產(chǎn)生,而是在特定的歷史條件下、特定的政治環(huán)境中才得以扎根。對波蘭違憲審查制度的產(chǎn)生和發(fā)展進行梳理,能夠加深對波蘭憲法法院的認(rèn)識。第二章分析了波蘭憲法法院的地位、組織構(gòu)成,以及職責(zé)權(quán)限。憲法法院制度是對傳統(tǒng)三權(quán)分立政治體制的發(fā)展與突破。波蘭現(xiàn)行憲法賦予憲法法院在國家體制中比較超然的地位,以明確的憲法條文闡述其管轄權(quán),包括對規(guī)范性法律文件的審查權(quán)、解決中央國家機關(guān)的權(quán)限爭議、審查政黨行為的合憲性、涉及侵害憲法權(quán)利的訴愿,反映了波蘭民主政治建設(shè)的現(xiàn)實需求。第三章較詳細(xì)地梳理了波蘭憲法法院適用的審查程序,包括審查程序的啟動、審查方式、審判組織、審理期限、判決效力等內(nèi)容。憲法法院的審查程序是法律技術(shù)問題,而法律技術(shù)的存在提供了將價值轉(zhuǎn)化為可操作的規(guī)范的路徑。第四章從運行實效的角度,分析波蘭憲法法院實際運行的特點。憲法法院違憲審查程序的啟動主體主要是特定國家公權(quán)力主體。波蘭憲法法院通過其審查實踐豐富了民主法治、平等、合比例等憲法原則的內(nèi)涵。但波蘭憲法法院也經(jīng)歷了從司法積極主義向司法自制主義的轉(zhuǎn)變,需要在履行違憲審查職能和尊重其他國家機關(guān)的權(quán)限之間尋找平衡點。結(jié)語部分,在總結(jié)前文的基礎(chǔ)上,作者提出三點啟示性結(jié)論:第一,我們必須以本國的政治體制為背景,建設(shè)有中國特色的違憲審查制度;第二,我們也應(yīng)在本國審查制度的框架內(nèi),更加注重程序的公開透明,加強公眾對審查程序的參與;第三,我們應(yīng)當(dāng)培養(yǎng)一批高水平的具備"憲法精神"的審查隊伍,由此才能真正保證憲法審查的公正性與權(quán)威性。
[Abstract]:In -20s, socialist Poland introduced the system of constitutional adjudication. As the predecessor of the Constitutional Court, the Polish Constitutional Court has gone through more than 30 years. The establishment of an authoritative position between the Polish state institutions and the public is playing an increasingly important role in the process of democratic political construction in Poland. On the basis of the introduction of the constitutional history of Poland, the first chapter is the study of the Polish Constitutional Court from the aspects of the content of the system and the characteristics of its operation. This paper expounds that the Polish Constitutional Court system is rooted in Poland's long constitutional tradition. The Constitutional Court system does not arise out of thin air, but under specific historical conditions. It is possible to deepen the understanding of the Polish Constitutional Court by combing the emergence and development of the Polish constitutional review system. Chapter two analyzes the status and organizational composition of the Polish Constitutional Court. The constitutional court system is the development and breakthrough of the traditional political system of separation of powers. The current Constitution of Poland gives the Constitutional Court a more transcendent position in the national system, stating its jurisdiction with clear constitutional provisions. Including the power of examining normative legal documents, resolving the jurisdiction disputes of the central state organs, examining the constitutionality of political parties' behavior, involving the appeal of infringing constitutional rights, It reflects the practical needs of the construction of democratic politics in Poland. Chapter III reviews in some detail the review procedures applied by the Polish Constitutional Court, including the initiation of the review procedure, the way of the review, the trial organization, and the duration of the trial. The review procedure of the Constitutional Court is a legal and technical issue, and the existence of legal technology provides a way to transform value into operational norms. Chapter 4th, from the perspective of operational effectiveness, This paper analyzes the characteristics of the actual operation of the Polish Constitutional Court. The starting subject of the Constitutional Court's unconstitutional review procedure is mainly the public power subject of a particular country. The Polish Constitutional Court enriches the democratic rule of law and equality through its review practice. But the Polish Constitutional Court has also undergone a shift from judicial activism to judicial self-control, and needs to find a balance between performing its unconstitutional review function and respecting the competence of other state organs. On the basis of the above, the author puts forward three enlightening conclusions: first, we must build the unconstitutional review system with Chinese characteristics against the background of our own political system; second, we should also be within the framework of our own censorship system. We should pay more attention to the openness and transparency of the procedure and strengthen the public participation in the review process. Thirdly, we should train a group of high level review teams with the spirit of the Constitution so as to truly guarantee the fairness and authority of the constitutional review.
