【摘要】： 農(nóng)民工作為社會(huì)轉(zhuǎn)型期的一個(gè)特殊群體為我國(guó)的城鄉(xiāng)經(jīng)濟(jì)發(fā)展作出了突出的貢獻(xiàn),當(dāng)前,對(duì)這一巨大群體的養(yǎng)老保險(xiǎn)制度完善顯得尤為重要。農(nóng)民工養(yǎng)老保險(xiǎn)制度的完善主要包括兩個(gè)層面:第一,是立法層面的完善。第二,是立法之外的社會(huì)舉措等層面的完善。本文首先概述完善農(nóng)民工養(yǎng)老保險(xiǎn)制度的意義,接著闡述了地方和國(guó)家在農(nóng)民工養(yǎng)老保險(xiǎn)制度方面的立法現(xiàn)狀,在此基礎(chǔ)上著重分析了其利弊得失,并指出我國(guó)農(nóng)民工養(yǎng)老保險(xiǎn)立法的完善方向。目前,農(nóng)民工養(yǎng)老保險(xiǎn)立法不夠完善,農(nóng)民工的養(yǎng)老保險(xiǎn)權(quán)益沒有得到有力的保護(hù)。社會(huì)舉措作為立法的重要補(bǔ)充在一定程度上可以緩解法律缺失帶來的諸多問題,“土地?fù)Q社�！笔墙�些年來興起的一種讓農(nóng)民工以土地權(quán)益換取社會(huì)保障的一項(xiàng)新舉措,這對(duì)保證農(nóng)民工的相關(guān)權(quán)益有一定的積極作用,但也存在不少的問題。鑒于此,筆者以上述問題為切入點(diǎn),窺探農(nóng)民工養(yǎng)老保險(xiǎn)社會(huì)舉措的全貌,并明示這些社會(huì)舉措的未來走向。
[Abstract]:As a special group in the social transition period, migrant workers have made outstanding contributions to the economic development of China's urban and rural areas. For this huge group of pension insurance system is particularly important. The improvement of migrant workers pension insurance system mainly includes two levels: first, is the legislative level of perfection. This paper first summarizes the significance of perfecting the pension insurance system for migrant workers, and then expounds the current legislative situation of the local and national pension insurance system for migrant workers. On this basis, the advantages and disadvantages of the analysis of the advantages and disadvantages, and pointed out the direction of our country's migrant workers pension insurance legislation to improve the direction. At present, migrant workers pension insurance legislation is not perfect. The pension insurance rights and interests of migrant workers have not been effectively protected. As an important supplement of legislation, social measures can alleviate many problems brought about by the lack of laws to a certain extent. "Land for Social Security" is a new measure to let migrant workers exchange land rights and interests for social security in recent years, which has a positive effect on ensuring the related rights and interests of migrant workers. However, there are still many problems. In view of this, the author takes the above problems as the starting point to probe into the whole picture of the social measures of the old-age insurance for migrant workers, and to indicate the future trend of these social measures.
